Government Property Traffic Act

72.1 Paragraph 2(1)(g) of the Government Property Traffic Act is replaced by the following:

    (g) prescribing a fine not exceeding five hundred dollars or a term of imprisonment not exceeding six months, or both, to be imposed on summary conviction as punishment for the contravention of any regulation; and

40. Subsection 74(1) of the Act is replaced by the following:

74. (1) Subsection 2(1) of the Act is replaced by the following:

Fingerprints and photographs

2. (1) The following persons may be fingerprinted or photographed or subjected to such other measurements, processes and operations having the object of identifying persons as are approved by order of the Governor in Council:

    (a) any person who is in lawful custody charged with or convicted of

      (i) an indictable offence, other than an offence that is designated as a contraven tion under the Contraventions Act in respect of which the Attorney General within the meaning of that Act has made an election under section 50 of that Act, or

      (ii) an offence under the Official Secrets Act;

    (b) any person who has been apprehended under the Extradition Act or the Fugitive Offenders Act; or

    (c) any person alleged to have committed an indictable offence, other than an offence that is designated as a contravention under the Contraventions Act in respect of which the Attorney General within the meaning of that Act has made an election under section 50 of that Act, who is required pursuant to subsection 501(3) or 509(5) of the Criminal Code to appear for the purposes of this Act by an appearance notice, promise to appear, recognizance or summons.

41. Section 76 of the Act is replaced by the following:

76. The Act is amended by adding the following after section 3:

DESTRUCTION OF FINGERPRINTS AND PHOTOGRAPHS

Destruction of fingerprints and photographs

4. Where a person charged with an offence that is designated as a contravention under the Contraventions Act is fingerprinted or photographed and the Attorney General within the meaning of that Act makes an election under section 50 of that Act, the fingerprints or photographs shall be destroyed.

42. The Act is amended by adding the following after section 80:

The National Battlefields at Quebec Act, 1914

80.1 Subsection 2 of section 4 of The National Battlefields at Quebec Act, 1914, being chapter 46 of the Statutes of Canada, 1914, is replaced by the following:

Offence and punishment

2. Every person who contravenes any by-law made under this section is liable on summary conviction to a fine of not more than two thousand dollars or to imprisonment for six months or to both.

43. Section 86 of the Act is replaced by the following:

Coming into force

86. (1) This Act or any provision thereof shall come into force throughout Canada or in any province on a day or days to be fixed by order of the Governor in Council made throughout Canada or in respect of that province.

Coming into force

(2) Section 84 shall come into force with respect to any provision of the schedule throughout Canada or in any province on a day or days to be fixed by order of the Governor in Council made throughout Canada or in respect of that province.

COMING INTO FORCE

Coming into force

44. This Act or any provision thereof shall come into force on a day or days to be fixed by order of the Governor in Council.
