SUMMARY

This enactment would amend the Contraventions Act and would make consequential amendments to certain other Acts respecting the treatment given to persons accused of committing an offence that has been designated as a contravention by the Governor in Council.

In addition to a number of technical and housekeeping amendments, the enactment would

    (a) permit the Governor in Council to make the offence scheme in effect in a province or territory (with any necessary changes) applicable to federal contraventions committed in that province or territory;

    (b) authorize the Minister of Justice to enter into agreements with provinces, territories, their municipalities and agents regarding the administration of the Act, including the prosecution of contraventions and the discharge and enforcement of fines;

    (c) authorize the Minister of Justice to enter into agreements with provinces, territories, and their municipalities to share revenue resulting from fines imposed as the result of a contravention and provide for the accounting of any such compensation; and

    (d) provide that, whether a contravention is subject to the federal scheme or a provincial or territorial scheme, certain fundamental principles continue to apply.
