SUMMARY

This enactment repeals section 43 of the Criminal Code (correction of child by force) in order to respond to the Truth and Reconciliation Commission of Canada’s call to action number 6.

Her Majesty, by and with the advice and consent of the Senate and House of Commons of Canada, enacts as follows:

Criminal Code

1Section 43 of the Criminal Code is repealed.

Coming into Force

30th day after royal assent

2This Act comes into force on the 30th day after the day on which it receives royal assent.

Clause 1:Text of section 43:

43Every schoolteacher, parent or person standing in the place of a parent is justified in using force by way of correction toward a pupil or child, as the case may be, who is under his care, if the force does not exceed what is reasonable under the circumstances.
