SUMMARY

This enactment amends the Citizenship Act to require that permanent residents who ordinarily reside in Quebec must have an adequate knowledge of French in order to obtain citizenship.

An Act to amend the Citizenship Act (adequate knowledge of French in Quebec)

Her Majesty, by and with the advice and consent of the Senate and House of Commons of Canada, enacts as follows:

R.‍S.‍, c. C-29

Citizenship Act

1(1)Paragraphs 5(1)‍(d) and (e) of the Citizenship Act are replaced by the following:

  • (d)if less than Insertion start 65 Insertion end years of age at the date of his or her application, has an adequate knowledge

    • Start of inserted block

      (i)of French, if he or she ordinarily resides in Quebec, or

      End of inserted block
    • Insertion start (ii) Insertion end of one of the official languages of Canada, Insertion start in all other cases Insertion end ;

  • (e)if less than Insertion start 65 Insertion end years of age at the date of his or her application, demonstrates that he or she has an adequate knowledge of Canada and of the responsibilities and privileges of citizenship

    • Start of inserted block

      (i)in French, if he or she ordinarily resides in Quebec, or

      End of inserted block
    • Insertion start (ii) Insertion end in one of the official languages of Canada, Insertion start in all other cases Insertion end ; and

(2)Subsection 5(2) of the Act is amended by striking out “and” at the end of paragraph (a), by adding “and” at the end of paragraph (b) and by adding the following after paragraph (b):

  • Start of inserted block

    (c)in the case of a minor who has attained the age of 14 years on or before the day on which the application is made and ordinarily resides in Quebec, he or she has an adequate knowledge of French.

    End of inserted block

2Subparagraphs 27(1)‍(d)‍(i) and (ii) of the Act are replaced by the following:

  • (i)has an adequate knowledge

    • Start of inserted block

      (A)of French, if the person ordinarily resides in Quebec, or

      End of inserted block
    • Insertion start (B) Insertion end of one of the official languages of Canada, Insertion start in all other cases Insertion end , or

  • (ii)has an adequate knowledge of Canada and of the responsibilities and privileges of citizenship, as demonstrated

    • Start of inserted block

      (A)in French, if the person ordinarily resides in Quebec,

      End of inserted block
    • Insertion start (B) Insertion end in one of the official languages of Canada, Insertion start in all other cases Insertion end ;
