SUMMARY

This enactment amends the Species at Risk Act in order to impose obligations on the Minister of the Environment in relation to the amendment of the List of Wildlife Species at Risk.

An Act to amend the Species at Risk Act (amendment of the List)

Her Majesty, by and with the advice and consent of the Senate and House of Commons of Canada, enacts as follows:

1(1)Subsection 27(1.‍1) of the Species at Risk Act is replaced by the following:

Decision in respect of assessment

(1.‍1)Within one year after receiving an assessment of the status of a species by COSEWIC, the Minister Insertion start shall make one of the following recommendations to Insertion end the Governor in Council:

  • (a) Insertion start that Insertion end the assessment Insertion start be accepted Insertion end and the species Insertion start be added Insertion end to the List;

  • (b) Insertion start that Insertion end the species not Insertion start be added Insertion end to the List;

  • (c) Insertion start that Insertion end the matter Insertion start be referred Insertion end back to COSEWIC for further information or consideration.

(2)Subsection 27(3) of the Act is replaced by the following:

Amendment of List by Minister

(3) Insertion start If Insertion end the Governor in Council has not taken Insertion start any Insertion end course of action under subsection (1.‍1) within Insertion start 30 days Insertion end after Insertion start the Minister has made a recommendation Insertion end , the Minister shall, by order, amend the List in accordance with COSEWIC’s assessment.

2The Act is amended by adding the following after section 27:

Report to Parliament

27.‍1If the Minister does not make an order as required under subsection 27(3), the Minister must prepare a report stating the reasons the order has not been made and indicating when it will be made and cause the report to be laid before each House of Parliament on any of the first 15 days on which that House is sitting after the report is completed.
