The Standing Joint Committee for the Scrutiny of Regulations met at 8:35 a.m., this day, in room 256-S, Centre Block, the Honourable J. Trevor Eyton and Mr. Derek Lee, Joint Chairs, presiding.

Representing the Senate: The Honourable Senators Bryden, Eyton, Harb, Massicotte and Moore (5).

Representing the House of Commons: Sue Barnes, David Christopherson, Carole Freeman, Betty Hinton, Rahim Jaffer, Denis Lebel, Derek Lee, Rick Norlock, Pierre Poilievre, Paul Szabo and Tom Wappel (11).

Also present: Christine Lafrance, Joint Clerk of the Committee (House of Commons); Peter Bernhardt, General Counsel, and Shawn Abel, Counsel, Parliamentary Information and Research Services, Library of Parliament.

In attendance: The official reporters of the Senate.

The committee proceeded to consider its permanent order of reference, as set out in section 19, the Statutory Instruments Act, R.S.C., 1985, c. S-22, which provides for the following:

Every statutory instrument issued, made or established after December 31, 1971, other than an instrument the inspection of which and the obtaining of copies of which are precluded by any regulations made pursuant to paragraph 20(d), shall stand permanently referred to any committee of the House of Commons, of the Senate or of both Houses of Parliament that may be established for the purpose of reviewing and scrutinizing statutory instruments.

In the matter of SOR/2004-232 — Order Amending the Saskatchewan Pulse Crop Marketing Levies (Interprovincial and Export) Order, it was agreed that witnesses from the National Farm Products Council be invited to appear before the committee.

In the matter of SOR/95-233 — Saskatchewan Fishery Regulations, 1995, it was agreed that the joint chairs invite Mr. Lee and the Deputy Minister of Fisheries and Oceans Canada to appear before the committee.

In the matter of SOR/98-2 — Regulations Amending the Fish Inspection Regulations, it was agreed that counsel to the committee correspond with the Designated Instruments Officer of the Canadian Food Inspection Agency with respect to certain comments made by the committee.

In the matter of SOR/99-169 — Regulations Amending the Fish Inspection Regulations, it was agreed that counsel to the committee correspond with the Designated Instruments Officer of the Canadian Food Inspection Agency with respect to certain comments made by the committee.

In the matter of SI/2005-2 — Order Giving Notice of Decisions not to add Certain Species to the List of Endangered Species, it was agreed to report the matter.

In the matter of SOR/95-500 — Power Line Crossing Regulations, it was agreed that counsel to the committee correspond with the Designated Instruments Officer of the National Energy Board with respect to certain comments made by the committee, after which the file will be closed.

In the matter of SOR/2003-219 — Passenger Information (Customs) Regulations, it was agreed that counsel to the committee correspond with the Designated Instruments Officer of the Canada Border Services Agency with respect to certain comments made by the committee.

In the matter of SOR/2006-242 — Regulations Amending the Patented Medicines (Notice of Compliance) Regulations, it was agreed that counsel to the committee correspond with the Designated Instruments Officer of Industry Canada with respect to certain comments made by the committee.

In the matter of SOR/2001-269 — Consumer Chemicals and Containers Regulations, 2001, it was agreed that counsel to the committee review their status at a later date and inform the committee of the action taken.

In the matter of SOR/2006-254 — First Nations Oil and Gas and Moneys Management Voting Regulations, it was agreed that counsel to the committee correspond with the Designated Instruments Officer of Indian Affairs and Northern Development Canada with respect to certain comments made by the committee.

In the matter of SOR/2002-145 — Manner of Disposal of Detained, Seized or Forfeited Goods Regulations (Preclearance Act), it was agreed that counsel to the committee correspond with the Designated Instruments Officer of Foreign Affairs and International Trade Canada with respect to certain comments made by the committee.

In the matter of Parks Canada User Fees: Service fee proposals for 2005/06 to 2008/09 and travel trade fee proposals for 2007/08 to 2009/10, it was agreed that the files be closed.

In the matter of SI/2006-98 — Order Respecting the Withdrawal from Disposal of Certain Lands in the Northwest Territories (Salt River First Nation, N.W.T.), it was agreed that the file be closed.

In the matter of SOR/2006-175 — Regulations Amending the Comprehensive Study List Regulations (Miscellaneous Program), it was agreed that the file be closed.

In the matter of SOR/2002-336 — Designated Provisions (Customs) Regulations, it was agreed that counsel to the committee review their status at a later date and inform the committee of the action taken.

In the matter of SOR/2007-18 — Regulations Amending the Fish Inspection Regulations, it was agreed that counsel to the committee review their status at a later date and inform the committee of the action taken.

In the matter of SOR/2007-140 — Regulations Amending the Migratory Birds Regulations, it was agreed that the file be closed.

In the matter of SOR/2007-263 — Regulations Amending Certain Regulations Made under the Canadian Environmental Assessment Act (Miscellaneous Program), it was agreed that the file be closed.

In the matter of SOR/2007-264 — Regulations Amending the Crown Corporations Involved in the Provision of Commercial Loans Environmental Assessment Regulations (Miscellaneous Program), it was agreed that the file be closed.
