The Standing Joint Committee for the Scrutiny of Regulations met this day at 8:34 a.m. in room 160-S, Centre Block, the Honourable Senator J. Trevor Eyton and Mr. Paul Szabo, M.P., Joint Chairs, presiding.

Representing the Senate: The Honourable Senators Bryden, Eyton, Harb and Moore (4).

Representing the House of Commons: Robert Bouchard, Dean Del Mastro, Paul Dewar, Ken Epp, John Maloney, Paul Szabo and Tom Wappel (7).

Other Member present: Randy Kamp (1).

In attendance: Mike Macpherson, Joint Clerk of the Committee (House of Commons); from the Research Branch, Library of Parliament: Peter Bernhardt, Senior Counsel, and Jacques Rousseau, Legal Counsel.

The committee continued to examine its order of reference as set out in section 19 of the Statutory Instruments Act, R.S.C. (1985), chapter S-22, which provides for the following:

Every statutory instrument issued, made or established after December 31, 1971, other than an instrument the inspection of which and the obtaining of copies of which are precluded by any regulations made pursuant to paragraph 20(d), shall stand permanently referred to any committee of the House of Commons, of the Senate or of both Houses of Parliament that may be established for the purpose of reviewing and scrutinizing statutory instruments.

Respecting SOR/89-93 — the minister made a statement, and then, together with Ms. Grealis and Mr. Belzile, answered questions. It was agreed that committee counsel would examine the file at a later date and keep the committee apprised of any action taken.

Respecting SOR/94-165 — Oil and Gas Occupational Safety and Health Regulations — Amendment, it was agreed that committee counsel would examine the file at a later date and keep the committee apprised of any action taken.

Respecting SOR/2002-337 — Charges for Services Provided by the Office of the Superintendent of Financial Institutions Regulations 2002, it was agreed to close the file.

Respecting SOR/2004-109 — Regulations Amending the Pulp and Paper Effluent Regulations, it was agreed that committee counsel would write to the statutory instruments officer at Environment Canada to share some of the committee’s observations.

Respecting SI/2004-122 — Order Respecting the Withdrawal from Disposal of Certain Lands (Ukkusiksalik National Park, Nunavut); SI/2004-132 — Withdrawal from Disposal of Certain Lands in Nunavut (Northern Bathurst Island National park, Nunavut), it was agreed to close the files.

Respecting SOR/2002-254 — Sulphur and Diesel Fuel Regulations; SOR/2005-305 — Regulations Amending the Sulphur and Diesel Fuel Regulations, it was agreed to close the files.

Respecting SOR/2000-108 — Export Control List Notification Regulations; SOR/2001-282 — Enhanced Survivor Annuity Regulations; SOR/2001-283 — Optional Survivor Annuity Regulations; SOR/2004-25 — Regulations Amending the Contraventions Regulations; SOR/2004-138 — Regulations Amending the Migratory Birds Convention Act; SOR/2005-297 — Regulations Amending the Weights and Measures Act, it was agreed that committee counsel would examine the files at a later date and keep the committee apprised of any action taken.

The Honourable Senator Harb moved:

That the Standing Joint Committee for the Scrutiny of Regulations appoint Ms. Lindsay Armstrong and Mr. Shawn Abel as Counsel for the Joint Committee, as per the terms agreed to between the Joint Committee and the Library of Parliament.

The question being put on the motion, it was resolved in the affirmative.
