The Standing Joint Committee for the Scrutiny of Regulations met this day at 8:39 a.m. in Room 256-S of the Centre Block, of the Centre Block, the Joint Chairs, the Honourable Senator J. Trevor Eyton and Mr Paul Szabo presiding.

Representing the Senate: The Honourable Senators Bryden, De Bané, P.C., Eyton, Harb and Moore (5).

Representing the House of Commons: Gérard Asselin (for Monique Guay), Robert Bouchard, Ron Cannan, Dean Del Mastro, Paul Dewar, Ken Epp, Derek Lee, Rick Norlock, Paul Szabo, Garth Turner, P.C., and Tom Wappel (11).

Also present: Mike Macpherson, Joint Clerk of the Committee (House of Commons); from the Parliamentary Research Branch of the Library of Parliament: François R. Bernier, General Counsel, and Peter Bernhardt, Counsel.

In attendance: The official reporters of the Senate.

The committee undertook to consider its standing order of reference as set out in section 19 of the Statutory Instruments Act, R.S.C. (1985), ch. S-22, which reads as follows:

Every statutory instrument issued, made or established after December 31, 1971, other than an instrument the inspection of which and the obtaining of copies of which are precluded by any regulations made pursuant to paragraph 20(d), shall stand permanently referred to any Committee of the House of Commons, of the Senate or of both Houses of Parliament that may be established for the purpose of reviewing and scrutinizing statutory instruments.

The Joint Chairs made a statement.

In the matter of SOR/89-93 – Ontario Fishery Regulations, 1989, the Honourable Senator Bryden moved that a letter giving notice of the committee's intention of passing a resolution calling for the repeal of a portion of the Regulations be sent to the Minister of Fisheries and Oceans.

The question being put on the motion, it was resolved in the affirmative.

In the matter of SOR/96-254 — Processing and Distribution of Semen for Assisted Conception Regulations; SOR/2000-299 — Regulations to amend the Processing and Distribution of Semen for Assisted Conception Regulations (1218 – other tests); SOR/2000-410 — Regulations to amend the Processing and Distribution of Semen for Assisted Conception Regulations (1238 – special access), it was agreed that the Joint Chairs would write to the Minister of Health to share some of the Committee's observations.

In the matter of C.R.C., c. 1325 — Public Lands Mineral Regulations, it was agreed that Counsel for the Committee would consider the matter at a later date and apprise the committee of any action taken.

In the matter of SOR/85-686 — Pest Control Products Regulations, it was agreed that Counsel for the Committee would consider the matter at a later date and apprise the committee of any action taken.

In the matter of SOR/95-405 — Response Organizations and Oil Handling Facilities Regulations, it was agreed that Counsel for the Committee would consider the matter at a later date and apprise the committee of any action taken.

In the matter of SOR/2000-205 — Class II Nuclear Facilities and Prescribed Equipment Regulations, it was agreed that Counsel for the Committee would write to the person in charge of regulatory instruments at the Canadian Nuclear Safety Commission to share some of the Committee's observations.

In the matter of SOR/2000-207 — Nuclear Substances and Radiation Devices Regulations, it was agreed that Counsel for the Committee would write to the person in charge of regulatory instruments at the Canadian Nuclear Safety Commission to share some of the Committee's observations

In the matter of SOR/2000-209 — Nuclear Security Regulations, it was agreed that Counsel for the Committee would write to the person in charge of regulatory instruments at the Canadian Nuclear Safety Commission to share some of the Committee's observations.

In the matter of SOR/2000-141 — Commissioner's Standing Orders (Dispute Resolution Process for Promotions and Job Requirements), it was agreed that the Joint Chairs would write to the Commissioner of the Royal Canadian Mounted Police to share some of the Committee's observations.

In the matter of SOR/97-390 — Crewing Regulations; SOR/2002-151 — Regulations Amending the Crewing Regulations, it was agreed that Counsel for the Committee would write to the person in charge of regulatory instruments at Transport Canada to share some of the Committee's observations.

In the matter of SOR/97-391 — Marine Certification Regulations; SOR/2002-150 — Regulations Amending the Marine Certification Regulations, it was agreed that Counsel for the Committee would write to the person in charge of regulatory instruments at Transport Canada to share some of the Committee's observations.

In the matter of SOR/2000-265 — Ship Station (Radio) Technical Regulations, 1999, it was agreed that Counsel for the Committee would consider the matter at a later date and apprise the committee of any action taken.

In the matter of SOR/2004-255 — Regulations Amending the Port Authorities Operations Regulations, it was agreed that Counsel for the Committee would write to the person in charge of regulatory instruments at Transport Canada to share some of the Committee's observations.

In the matter of SOR/93-486 — Regulations Amending the Canadian Wheat Board Regulations, it was agreed that Counsel for the Committee would write to the person in charge of regulatory instruments at the Canadian Wheat Board to share some of the Committee's observations.

In the matter of SOR/2004-134 — Regulations Amending the Canadian Wheat Board Regulations; SOR/2005-36 — Regulations Amending the Canadian Wheat Board Regulations; SOR/2005-140 — Regulations Amending the Canadian Wheat Board Regulations; SOR/2005-233 — Regulations Amending the Canadian Wheat Board Regulations, it was agreed to close these files.
