SUMMARY

This enactment amends the Criminal Code, in relation to the offence of assault, to expand the aggravating circumstance of assaulting a public transit operator to include all public transit workers.

An Act to amend the Criminal Code (public transit workers)

His Majesty, by and with the advice and consent of the Senate and House of Commons of Canada, enacts as follows:

Criminal Code

1Section 269.‍01 of the Criminal Code is replaced by the following:

Aggravating circumstance — assault against a public transit worker

269.‍01(1)When a court imposes a sentence for an offence referred to in paragraph 264.‍1(1)‍(a) or any of sections 266 to 269, it shall consider as an aggravating circumstance the fact that the victim of the offence was, at the time of the commission of the offence, a public transit Insertion start worker Insertion end engaged in the performance of Insertion start their Insertion end duty.

Definition of public transit

(2)In this section, public transit means a passenger transportation service provided to the public — including paratransit and school bus services — using a vehicle such as a bus, train, subway, tram, ferry or licensed taxi cab.
