SUMMARY |

This enactment amends the Immigration Act to make the penalties
for offences relating to unlawful entry into Canada more stringent and
to make prosecution easier.
|
|
|
Specifically, the enactment
|
|
|
increases the fine for organizing unlawful entry into Canada from one
hundred thousand dollars to two hundred thousand dollars and the term
of imprisonment from a maximum of five years to a maximum of ten
years;
|
|
|
in relation to the offence of organizing unlawful entry into Canada for
a group of persons, reduces the size of the group from ten or more
persons to five or more persons and increases the maximum penalty for
the offence from ten years to twenty years;
|
|
|
repeals a provision requiring the personal consent of the Attorney
General of Canada or the Deputy Attorney General of Canada for a
prosecution of the two offences relating to organizing unlawful entry
into Canada;
|
|
|
increases the maximum term of imprisonment for disembarking
persons at sea for the purposes of unlawful entry into Canada from ten
years to twenty years.
