Access to Information Act

21. (1) Subsection 13(1) of the Access to Information Act is amended by striking out the word ``or'' at the end of paragraph (c), by adding the word ``or'' at the end of paragraph (d) and by adding the following after paragraph (d):

    (e) an aboriginal government.

(2) Section 13 of the Act is amended by adding the following after subsection (2):

Definition of ``aboriginal government''

(3) The expression ``aboriginal government'' in paragraph (1)(e) means Nisga'a Government, as defined in the Nisga'a Final Agreement given effect by the Nisga'a Final Agreement Act.

Fisheries Act

22. Section 5 of the Fisheries Act is amended by adding the following after subsection (3):

Nisga'a laws

(4) The powers and protections that a fishery officer or fishery guardian has under this or any other Act of Parliament, including the powers and protections of a peace officer under the Criminal Code, apply to a fishery officer or fishery guardian enforcing Nisga'a laws made under the Fisheries Chapter of the Nisga'a Final Agreement given effect by the Nisga'a Final Agreement Act.

23. The Act is amended by adding the following after section 33:

Definition of ``fishing plan''

33.1 (1) In this section, ``fishing plan'' means a Nisga'a annual fishing plan, as defined in the Fisheries Chapter of the Nisga'a Final Agreement given effect by the Nisga'a Final Agreement Act, that is approved, or varied and approved, by the Minister in accordance with that Agreement.

tion of fishing plan

(2) Where a fishing plan stipulates that this subsection applies to certain of its provisions relating to persons engaged in harvesting, sale or related activities, no person shall contravene any of those provisions.

Conditions of prosecution

(3) No proceedings may be commenced in respect of an offence for the contravention of subsection (2)

    (a) except in accordance with an agreement, made under paragraph 93 of the Fisheries Chapter of the Nisga'a Final Agreement, concerning enforcement of federal laws or Nisga'a laws; or

    (b) unless the Minister, or a person appointed to a position in the Department of Fisheries and Oceans who is authorized by the Minister, considers such proceedings to be necessary to ensure compliance with the fishing plan.

Lobbyists Registration Act

24. Subsection 4(1) of the Lobbyists Regis tration Act is amended by adding the following after paragraph (d.1):

    (d.2) members of Nisga'a Government, as defined in the Nisga'a Final Agreement given effect by the Nisga'a Final Agreement Act, persons on the staff of those members or employees of the Nisga'a Nation, a Nisga'a Village or a Nisga'a Institution, as defined in that Agreement;

Municipal Grants Act

25. The definition ``taxing authority'' in subsection 2(1) of the Municipal Grants Act is amended by striking out the word ``or'' at the end of paragraph (d), by adding the word ``or'' at the end of paragraph (e) and by adding the following after paragraph (e):

      (f) the Nisga'a Nation or a Nisga'a Village, as defined in the Nisga'a Final Agreement given effect by the Nisga'a Final Agreement Act, if it levies and collects a real property tax or a frontage or area tax in respect of Nisga'a Lands, as defined in that Agreement.

Privacy Act

26. (1) Paragraph 8(2)(k) of the Privacy Act is replaced by the following:

    (k) to any aboriginal government , association of aboriginal people, Indian band, government institution or part thereof, or to any person acting on behalf of such government , association, band, institution or part thereof, for the purpose of researching or validating the claims, disputes or grievances of any of the aboriginal peoples of Canada;

(2) Section 8 of the Act is amended by adding the following after subsection (6):

Definition of ``aboriginal government''

(7) The expression ``aboriginal government'' in paragraph (2)(k) means Nisga'a Government, as defined in the Nisga'a Final Agreement given effect by the Nisga'a Final Agreement Act.

COMING INTO FORCE

Order of Governor in Council

27. The provisions of this Act come into force on a day or days to be fixed by order of the Governor in Council.
