Amendments to the Canada Pension Plan

43. (1) The portion of subsection 82(3) of the Canada Pension Plan before paragraph (b) is replaced by the following:

Panel

(3) The Governor in Council shall appoint a panel of at least one hundred persons resident in Canada, in such a way that, at any given time,

    (a) at least twenty-five per cent of the members of the panel are members of the bar of a province or of the Chambre des notaires du Québec ;

(2) Paragraph 82(7)(a) of the Act is replaced by the following:

    (a) the Commissioner must designate a member of the bar of a province or of the Chambre des notaires du Québec as the Chairman of the Review Tribunal; and

Amendments to the Canadian Centre for Occupational Health and Safety Act

44. (1) The definitions ``Chairman'' and ``executive board'' in section 3 of the English version of the Canadian Centre for Occupational Health and Safety Act are repealed.

(2) Section 3 of the English version of the Act is amended by adding the following in alphabetical order:

``Chairperson'' means the Chairperson of the Council;

45. (1) The portion of section 4 of the French version of the Act before paragraph (a) is replaced by the following:

(2) Paragraphs 4(c) to (e) of the Act are replaced by the following:

    (d) four other governors to be appointed after consultation with such organizations representative of workers as the Governor in Council considers appropriate; and

    (e) four other governors to be appointed after consultation with such organizations representative of employers as the Governor in Council considers appropriate.

46. (1) Subsection 7(1) of the Act is replaced by the following:

Chairperson

7. (1) The Chairperson shall be appointed to hold office during pleasure for a term not exceeding five years.

Tenure of office

(2) For greater certainty, a person who holds office as Chairman of the Canadian Centre for Occupational Health and Safety immediately before the coming into force of subsection (1) continues in office as Chairperson of the Canadian Centre for Occupational Health and Safety during good behaviour for the remainder of the term for which the person was appointed, but may be removed by the Governor in Council for cause.

47. (1) Subsection 10(2) of the Act is replaced by the following:

(2) Every President holds office during pleasure .

(2) For greater certainty, a person who holds office as President of the Canadian Centre for Occupational Health and Safety immediately before the coming into force of subsection (1) continues in office during good behaviour for the remainder of the term for which the person was appointed, but may be removed by the Governor in Council for cause.

48. Subsection 11(1) of the Act is replaced by the following:

Duties of President

11. (1) The President is the chief executive officer of the Centre, has supervision over and direction of the work and staff of the Centre and shall perform such duties as are assigned to the President by the Council.

49. The heading before section 14 and sections 14 and 15 of the Act are repealed.

50. Section 18 of the Act is replaced by the following:

Remunera-
tion

18. The President and any acting President shall be paid any remuneration and expenses that are fixed by the Governor in Council.

51. Subsection 21(1) of the Act is replaced by the following:

Meetings of Council

21. (1) The Council shall meet at least three times in each year, with at least one of those meetings at the head office of the Centre, and at any other times and places in Canada that the Chairperson considers necessary.

52. Paragraphs 22(c) and (d) of the Act are replaced by the following:

    (c) the procedure in all business at meetings of the Council; and

Terminology

53. The English version of the Act is amended by replacing the word ``Chairman'' with the word ``Chairperson'' in the following provisions:

    (a) paragraph 4(a);

    (b) subsections 7(2) to (4);

    (c) section 8;

    (d) section 19;

    (e) subsection 21(2);

    (f) subsection 23(1); and

    (g) subsection 23(4).

Canadian Film Development Corporation

Amendments to the Canadian Film Development Corporation Act

54. Subsection 4(2) of the Canadian Film Development Corporation Act is replaced by the following:

Chairperson

(2) The Governor in Council shall designate one of the members of the Corporation to serve as chairperson of the Corporation during pleasure and the chairperson may receive such fees as are fixed by the Governor in Council.

55. Section 11 of the Act is replaced by the following:

Meetings

11. The members of the Corporation shall meet at such times and places as they consider necessary.

56. Subsection 12(1) of the Act is replaced by the following:

Executive director and secretary

12. (1) The Governor in Council may, on the recommendation of the Minister after consultation with the Corporation, appoint an executive director of the Corporation, who shall hold office during pleasure and shall be paid such remuneration as is fixed by the Governor in Council.

Amendments to the Canadian International Trade Tribunal Act

57. (1) The definition ``Chairman'' in subsection 2(1) of the English version of the Canadian International Trade Tribunal Act is repealed.

(2) Subsection 2(1) of the English version of the Act is amended by adding the following in alphabetical order:

``Chairperson'' means the Chairperson of the Tribunal;

58. (1) Subsection 3(1) of the Act is replaced by the following:

Tribunal established

3. (1) There is hereby established a tribunal, to be known as the Canadian International Trade Tribunal, consisting, subject to subsection (2), of not more than nine permanent members to be appointed by the Governor in Council.

(2) Subsection 3(5) of the Act is replaced by the following:

Re-
appointment of permanent members

(5) A permanent member, on the expiration of a first term of office, is eligible to be re-appointed in the same or another capacity.

59. (1) The Act is amended by adding the following after section 3:

Chairperson and Vice-
Chairperson

3.1 The Governor in Council shall designate one of the members appointed under subsection 3(1) to hold office as Chairperson and two to hold office as Vice-Chairpersons.

(2) For greater certainty, each person who holds office as Chairman or Vice-Chairman of the Canadian International Trade Tribunal immediately before the coming into force of subsection (1) continues in office during good behaviour as Chairperson or Vice-Chairperson, as the case may be, of the Tribunal for the remainder of the term for which the person was appointed, but may be removed by the Governor in Council for cause.

60. Subsections 6(2) and (3) of the Act are replaced by the following:

Expenses

(2) Each member is entitled to be paid reasonable travel and living expenses incurred by the member while absent from the member's ordinary place of work in the course of performing duties under this Act.

61. Subsection 8(1) of the English version of the Act is replaced by the following:

Absence, etc., of Chairperson

8. (1) In the event of the absence or incapacity of the Chairperson or if the office of Chairperson is vacant, the Tribunal may authorize one of the Vice-Chairpersons to act as Chairperson for the time being, and a Vice-Chairperson so authorized has and may exercise and perform all the powers, duties and functions of the Chairperson .

62. Section 10 of the Act is amended by adding the following after subsection (3):

Compensa-
tion

(4) The members of the Tribunal are deemed to be employees for the purposes of the Government Employees Compensation Act and to be employed in the public service of Canada for the purposes of any regulations made pursuant to section 9 of the Aeronautics Act.

Terminology

63. The English version of the Act is amended by replacing the word ``Chairman'' with the word ``Chairperson'' in the following provisions:

    (a) section 7;

    (b) subsection 8(2);

    (c) section 9;

    (d) subsection 14(2);

    (e) subsection 30.11(3);

    (f) subsection 33(1); and

    (g) subsections 59(1) and (2).

Conditional Amendment

Bill C-35

64. If Bill C-35, introduced in the first session of the thirty-sixth Parliament and entitled An Act to amend the Special Import Measures Act and the Canadian International Trade Tribunal Act, is assented to, then,

    (a) if section 53 of that Act comes into force before section 57 of this Act, section 57 is repealed;

    (b) if section 57 of this Act comes into force before section 53 of that Act, section 53 of that Act is repealed;

    (c) if subsection 58(1) of this Act comes into force before section 54 of that Act, section 54 of that Act is repealed;

    (d) if section 55 of that Act comes into force before section 61 of this Act, section 61 is repealed;

    (e) if section 61 of this Act comes into force before section 55 of that Act, section 55 of that Act is repealed;

    (f) if section 61 of that Act comes into force before section 63 of this Act, section 63 is repealed; and

    (g) if section 63 of this Act comes into force before section 61 of that Act, section 61 of that Act is repealed.
