Amendments to the Emergency Preparedness Act

23. The definition ``service'' in section 2 of the French version of the Emergency Preparedness Act is repealed.

24. The heading before section 3 and sections 3 and 4 of the Act are replaced by the following:

RESPONSIBILITIES OF THE MINISTER

Ministerial responsibility

4. The Minister is responsible for advancing civil preparedness in Canada for emergencies of all types, including war and other armed conflict, by facilitating and coordinating, among government institutions and in cooperation with provincial governments, foreign governments and international organizations, the development and implementation of civil emergency plans.

25. (1) The portion of subsection 5(1) of the Act before paragraph (a) is replaced by the following:

(3) The Minister has such other responsibilities in relation to civil preparedness for emergencies as the Governor in Council may, by order, specify.

26. Section 6 of the Act is replaced by the following:

6. The Minister may, with the approval of the Governor in Council, enter into an agreement with the government of any province respecting civil emergency plans.

27. The heading before section 7 of the Act is replaced by the following:

(2) The Minister of Fisheries and Oceans may do and perform all acts and things necessary for and incidental to closing out the affairs of the Fisheries and Oceans Research Advisory Council.

      (e) a person designated as a fishery guardian under the Fisheries Act when performing any duties or functions under that Act and a person designated as a fishery officer under the Fisheries Act when performing any duties or functions under that Act, the Coastal Fisheries Protection Act or the Northern Pacific Halibut Fisheries Convention Act,

40. On the later of the coming into force of section 39 of this Act and subsection 59(1) of the Miscellaneous Statute Law Amendment Act, 1993, paragraph (e) of the definition ``peace officer'' in section 2 of the Criminal Code is replaced by the following:

42. (2) The Minister of National Health and Welfare may do and perform all acts and things necessary for and incidental to closing out the affairs of the National Advisory Council on Fitness and Amateur Sport.

43. If Bill C-53, introduced in the first session of the thirty-fifth Parliament and entitled An Act to establish the Department of Canadian Heritage and to amend and repeal certain other Acts, is assented to, then subsection 42(2) of this Act is replaced by the following:

(2) The member or members of the Queen's Privy Council for Canada designated by the Governor in Council as the Minister for the purposes of the Fitness and Amateur Sport Act may do and perform all acts and things necessary for and incidental to closing out the affairs of the National Advisory Council on Fitness and Amateur Sport.
