      Her Majesty, by and with the advice and consent of the Senate and House of Commons of Canada, enacts as follows:

1. Subsection 161(1) of the Criminal Code is amended by adding the following after paragraph (a):

    (a.1) being in a dwelling house where the offender knows or ought to know that a person under the age of fourteen years is present and that the person who has custody or control of the person under the age of fourteen years is not present;
