RECOMMENDATION

Her Excellency the Governor General recommends to the House of Commons the appropriation of public revenue under the circumstances, in the manner and for the purposes set out in a measure entitled ``An Act to give effect to the Westbank First Nation Self-Government Agreement''.

SUMMARY

This enactment gives effect to the Westbank First Nation Self-Government Agreement. It includes related amendments to several other Acts.

EXPLANATORY NOTES

Access to Information Act

Clause 16: Subsection 13(3) reads as follows:

(3) The expression ``aboriginal government'' in paragraph (1)(e) means Nisga'a Government, as defined in the Nisga'a Final Agreement given effect by the Nisga'a Final Agreement Act.

Lobbyists Registration Act

Clause 17: New. The relevant portion of subsection 4(1) reads as follows:

4. (1) This Act does not apply to any of the following persons when acting in their official capacity, namely,

Privacy Act

Clause 18: (1) The relevant portion of subsection 8(2) reads as follows:

(2) Subject to any other Act of Parliament, personal information under the control of a government institution may be disclosed

    . . .

    (f) under an agreement or arrangement between the Government of Canada or an institution thereof and the government of a province, the government of a foreign state, an international organization of states or an international organization established by the governments of states, or any institution of any such government or organization, for the purpose of administering or enforcing any law or carrying out a lawful investigation;

(2) Subsection 8(8) is new. Subsection 8(7) reads as follows:

(7) The expression ``aboriginal government'' in paragraph (2)(k) means Nisga'a Government, as defined in the Nisga'a Final Agreement given effect by the Nisga'a Final Agreement Act.

Clause 19: New. The relevant portion of subsection 19(1) reads as follows:

19. (1) Subject to subsection (2), the head of a government institution shall refuse to disclose any personal information requested under subsection 12(1) that was obtained in confidence from
