An Act to amend the Immigration and Refugee Protection Act

2001, c. 27

      Her Majesty, by and with the advice and consent of the Senate and House of Commons of Canada, enacts as follows:

1. Section 11 of the Immigration and Refugee Protection Act is amended by adding the following after subsection (2):

Security

(3) An officer may require a foreign national who has applied for a visa to enter Canada as a temporary resident to provide security as a condition of the issuance of the visa, which security shall be forfeited if the foreign national does not leave Canada by the end of the period authorized for their stay or fails to comply with any other condition of the visa or any requirement of this Act.

Regulations

(4) The regulations may provide for any matter relating to the providing or forfeiting of security under subsection (3).

Removal of foreign national

(5) A foreign national referred to in subsection (3) who has not left Canada by the end of the period authorized for their stay or who has failed to comply with any other condition of the visa or any requirement of this Act shall immediately be removed from Canada to the country from which they applied for the visa without the right to appeal the decision to remove or to apply to remain in Canada on any other basis.

2. This Act comes into force on the day on which section 11 of the Immigration and Refugee Protection Act, chapter 27 of the Statutes of Canada, 2001, comes into force.
