An Act to establish a National Historic Park to commemorate the “Persons Case”

WHEREAS, on October 18, 1929, the Judicial Committee of the Privy Council declared that women were “Persons” within the meaning of section 24 of the Constitution Act, 1867, thereby entitling women to become eligible to be summoned to and become members of the Senate of Canada;

AND WHEREAS the “Persons Case” was a landmark decision, the long term effects of which were to make the Parliament of Canada and other federal bodies more representative of Canadian society and to improve the status of women in Canadian society;

AND WHEREAS it is desirable to dedicate a park to all Canadians to commemorate and honour the “Persons Case” by designating a location in the National Capital Region as a National Historic Park;

NOW, THEREFORE, Her Majesty, by and with the advice and consent of the Senate and House of Commons of Canada, enacts as follows:

1. This Act may be cited as the Persons Case National Historic Park Act.

2. The lands described in the schedule are hereby set apart as a National Historic Park of Canada with like effect as though they had been set apart as a National Historic Park by the Governor in Council under and in compliance with subsection 9(1) of the National Parks Act.

3. The official name of the National Historic Park of Canada established by section 2 is the “Persons Case National Historic Park”.

4. In honour of and to commemorate the “Persons Case”, the National Historic Park of Canada established by section 2 is dedicated to the people of Canada as a public park for their use, benefit and education, and for the enjoyment of future generations of Canadians.

5. Part II of the National Parks Act applies to the National Historic Park of Canada established under section 2.

6. This Act is binding on Her Majesty in right of Canada.
