Her Majesty, by and with the advice and consent of the Senate and House of Commons of Canada, enacts as follows:

1. Subsection 11(3) of the Old Age Security Act is replaced by the following:
|

Application deemed to be made and approved
|
|
(3) An application under subsection (2) is deemed to have been made by a person and approved on the day on which the person reached sixty-five years of age, if the information in support of the application has been made available to the Minister under this Act. The Minister shall take all necessary measures to obtain the information and, if the information is obtained, the Minister shall give written notice to the person before payment of the supplement commences.

(3) La demande prévue au paragraphe (2) est réputée présentée et agréée à la date où la personne a atteint l’âge de soixante-cinq ans dans le cas où les renseignements appuyant la demande ont été rendus accessibles au ministre sous le régime de la présente loi. Le ministre prend toutes les mesures nécessaires à l’obtention des renseignements et, s’il les obtient, il avise la personne par écrit avant le début du versement du supplément.

(3.1) An applicant may withdraw an application for a supplement by giving a written notice of the withdrawal to the Minister at any time before payment of the supplement commences.
|

Effect of withdrawal
|
|
(3.2) If an application for a supplement is withdrawn under subsection (3.1), the withdrawn application shall not after that time be used for the purpose of determining the applicant’s eligibility for a supplement, and the approval of a new application for a supplement shall not be effective as of the day on which the applicant attained the age of sixty-five years.
|
|
|
|
(3.2) La demande de supplément ainsi retirée ne peut, par la suite, servir à déterminer l’admissibilité du demandeur au supplément et l’effet de l'agrément d’une nouvelle demande ne peut être rétroactif à la date du soixante-cinquième anniversaire de naissance du demandeur.
