2. The Act is amended by adding the following after section 402:

Tampering with vehicle identification number

402.1 (1) Every person commits an offence who, without lawful excuse, the proof of which lies on the person, alters, defaces or removes a vehicle identification number on a motor vehicle.

402.1 (1) Commet une infraction quiconque, sans excuse légitime, dont la preuve lui incombe, modifie, maquille ou enlève le numéro d’identification d’un véhicule à moteur.

(2) For the purposes of subsection (1), “vehicle identification number” has the same meaning as in subsection 354(3).

Punishment

(3) Every person who commits an offence under subsection (1)

(a) is guilty of an indictable offence and liable to imprisonment for a term not exceeding five years; or

(b) is guilty of an offence punishable on summary conviction.

(3) Quiconque commet l’infraction prévue au paragraphe (1) est coupable :

a) soit d’un acte criminel passible d’un emprisonnement maximal de cinq ans;

b) soit d’une infraction punissable sur déclaration de culpabilité par procédure sommaire.
