Northwest Territories Act

87. The Northwest Territories Act is amended by adding the following after section 21:

Regulations Act does not apply

21.1 The Regulations Act does not apply to an ordinance or to any document made under an ordinance.

Northwest Territories Waters Act

88. Subsection 13(4) of the Northwest Territories Waters Act is replaced by the following:

Policy direction not a regulation

(4) A policy direction is not a regulation for the purposes of the Regulations Act.

Nunavut Act

89. The Nunavut Act is amended by adding the following after section 38:

Regulations Act

Regulations Act does not apply

38.1 The Regulations Act does not apply to a law made by the Legislature or continued by section 29, a rule made by the Assembly pursuant to section 21 or any regulation made under such a law or rule.

90. Section 131 of Schedule III to the Act and the heading before it are repealed.

Canada Oil and Gas Operations Act

1994, c. 10, s. 1

91. Section 3.2 of the Canada Oil and Gas Operations Act and the heading before it are replaced by the following:

Orders

3.2 For greater certainty, an order made by a safety officer, the Chief Safety Officer, a conservation officer, the Chief Conservation Officer, the Committee or the National Energy Board is not a regulation for the purposes of the Regulations Act.

(3) For greater certainty, guidelines and interpretation notes issued pursuant to subsections (1) and (2) are not regulations for the purposes of the Regulations Act.

93. Subsection 16.1(6) of the Act is replaced by the following:

(6) A declaration or a revocation made under this section is not a regulation for the purposes of the Regulations Act, but shall be published in the Canada Gazette within seven days after it is made.

Plant Protection Act

97. Section 18 of the Plant Protection Act is replaced by the following:

Not a regulation

18. A declaration under section 11 or 12, a revocation of a declaration under subsection 15(2) and an order under subsection 15(3) are not regulations for the purposes of the Regulations Act, but the Minister shall take such steps as may be practicable in the circumstances to bring any order under subsection 15(3) to the notice of persons likely to be affected by it.

Railway Safety Act

98. Section 46 of the Railway Safety Act and the heading before it are replaced by the following:

Regulations Act

Ministerial orders, etc., not to be regulations

46. Orders, emergency directives or notices of approval made or sent by the Minister, rules filed under section 19 or 20 and approved by the Minister, notices of exemption under subsection 22(2), notices referred to in section 32, measures established under subsection 39(3), or orders made by a railway safety inspector, are not regulations for the purposes of the Regulations Act.

99. Subsection 7(5) of the Referendum Act is replaced by the following:

101. Subsection 660.6(2) of the Canada Shipping Act is replaced by the following:

Standards not regulations

(2) For greater certainty, standards issued by the Minister under this section are not regulations for the purposes of the Regulations Act.

1993, c. 44, s. 218

102. Subsection 77.029(5) of the Special Import Measures Act is replaced by the following:

Order not a regulation

(5) An order made under subsection (1) is not a regulation for the purposes of the Regulations Act.

Statute Revision Act

103. Subsection 11(3) of the Statute Revision Act is replaced by the following:

Definition of ``regulations''

(3) In this Part, ``regulations'' means

    (a) statutory orders and regulations published in the 1978 Consolidation of Statutory Orders and Regulations;

    (b) regulations and other documents published in Part II of the Canada Gazette since the publication of the 1978 Consolidation; and

    (c) any other regulations or documents that, in the opinion of the Commission, are of continuing effect or apply to more than one person or body, other than regulations that are exempted from

      (i) the application of the regulatory process under subsection 5(1) or 28(1) of the Regulations Act, or

      (ii) publication in the Canada Gazette under subsection 11(3) or paragraph 26(g) of that Act.

104. Subsections 19(2) and (3) of the Act are replaced by the following:

Scrutiny committee of Parliament

(2) A regulation included in the Consolidated Regulations stands permanently referred to any committee of Parliament established under section 25 of the Regulations Act.

Transportation of Dangerous Goods Act, 1992

105. Subsection 13(3) of the Transportation of Dangerous Goods Act, 1992 is replaced by the following:

Notification of direction

(3) No person shall be convicted of an offence under subsection (2) unless the person was notified of the direction and, if any applicable regulations have been made under paragraph 27(1)(t), the notification was in accordance with the regulations.

106. Subsection 31(3) of the Act is replaced by the following:

Oral permit

(3) A permit issued under subsection (2) is not a regulation for the purposes of the Regulations Act and may be issued orally, but must be reissued in writing as soon as practicable and the writing is conclusive of its content.

107. Section 528 of the Trust and Loan Companies Act is repealed.

108. The Yukon Act is amended by adding the following after section 22:

109. Subsection 10(7) of the Yukon First Nations Self-Government Act is replaced by the following:

(7) The Regulations Act does not apply in respect of laws enacted by a first nation.

Yukon Surface Rights Board Act

110. Subsection 41(3) of the Yukon Surface Rights Board Act is replaced by the following:

Exemption from regulatory process

(3) The rules of the Board are exempt from the application of the regulatory process under the Regulations Act.

111. Subsection 13(4) of the Yukon Waters Act is replaced by the following:

CONDITIONAL AMENDMENTS

Bill C-43

112. If Bill C-43, introduced in the first session of the thirty-fifth Parliament and entitled An Act to amend the Lobbyists Registration Act and to make related amendments to other Acts, is assented to, then on the later of the coming into force of the definition ``regulation'' in section 2 of this Act and the coming into force of

    (a) section 3 of that Act, the Lobbyists Registration Act is amended as follows:

      (i) subparagraph 5(1)(a)(iii) is replaced by the following:

      (iii) the making or amendment of any regulation as defined in section 2 of the Regulations Act,

      (ii) paragraph 6(1)(c) is replaced by the following:

    (c) the making or amendment of any regulation as defined in section 2 of the Regulations Act,

      (iii) paragraph 7(1)(c) is replaced by the following:

    (c) the making or amendment of any regulation as defined in section 2 of the Regulations Act,

    (b) section 5 of that Act, the Lobbyists Registration Act is amended as follows:

      (i) subsection 10(2) is replaced by the following:

Interpretation bulletins not binding

(2) The advisory opinions and interpretation bulletins are not binding.

      (ii) subsection 10.2(4) is replaced by the following:

Code not a regulation

(4) The Code is not a regulation for the purposes of the Regulations Act, but the Code shall be published in the Canada Gazette.

Bill C-53

113. If Bill C-53, introduced in the first session of the thirty-fifth Parliament and entitled An Act to establish the Department of Canadian Heritage and to amend and repeal certain other Acts, is assented to, then subsection 11(3) of that Act is replaced by the following:

Reference to scrutiny committee

(3) A fee fixed under section 8, 9 or 10 shall stand permanently referred to a committee described in section 25 of the Regulations Act to be scrutinized as if it were a regulation.

Bill C-62

114. If Bill C-62, introduced in the first session of the thirty-fifth Parliament and entitled An Act to provide for the achievement of regulatory goals through alternatives to designated regulations and through administrative agreements, is assented to, then

    (a) the definition ``regulation'' in section 2 of that Act is replaced by the following:

``regulation''

``regulation'' means a regulation as defined in section 2 of the Regulations Act and includes any portion of such a regulation;

    (b) section 16 of that Act is replaced by the following:

Compliance plans, etc., not regulations

16. Compliance plans, procedures and factors for evaluating and approving them, administrative agreements and notices approved, made or published under this Act are not regulations for the purposes of the Regulations Act.
