SUMMARY
This enactment amends the Criminal Code to prescribe a minimum punishment of five years when a kidnap victim is under sixteen years of age.

Le texte modifie le Code criminel afin de prévoir une peine d’emprisonnement minimal de cinq ans lorsque la victime d’un enlèvement est âgée de moins de seize ans.

Her Majesty, by and with the advice and consent of the Senate and House of Commons of Canada, enacts as follows:
Sa Majesté, sur l’avis et avec le consentement du Sénat et de la Chambre des communes du Canada, édicte :
L.R., ch. C-46
1. Subsection 279(1.1) of the Criminal Code is amended by striking out “and” at the end of paragraph (a.1) and by adding the following after that paragraph:
1. Le paragraphe 279(1.1) du Code criminel est modifié par adjonction, après l’alinéa a.1), de ce qui suit :
(a.2) if the person referred to in paragraph (1)(a), (b) or (c) is under 16 years of age, to imprisonment for life and to a minimum punishment of imprisonment for a term of five years; and
a.2) si la personne visée aux alinéas (1)a), b) ou c) est âgée de moins de seize ans, de l’emprisonnement à perpétuité, la peine minimale étant de cinq ans;
