Sommaire

 This enactment amends section 161 of the Criminal Code to permit a court to make an order prohibiting an offender convicted of a sexual offence from being in a dwelling-house where the offender knows or ought to know that a person under the age of fourteen years is present and that the parent, guardian or any other person who has the lawful care or charge of the person under the age of fourteen years is not present.

Le texte modifie l’article 161 du Code criminel afin de permettre au tribunal d’interdire au contrevenant déclaré coupable d’une infraction de nature sexuelle de se trouver dans une maison d’habitation où il sait ou devrait savoir qu’il s’y trouve une personne de moins de quatorze ans, sans la présence du père, de la mère, du tuteur ou de toute autre personne ayant la garde ou la charge légale de celle-ci.

Her Majesty, by and with the advice and consent of the Senate and House of Commons of Canada, enacts as follows:

Sa Majesté, sur l’avis et avec le consentement du Sénat et de la Chambre des communes du Canada, édicte :

1. Subsection 161(1) of the Criminal Code is amended by adding the following after paragraph (a):

(a.1) being in a dwelling-house where the offender knows or ought to know that a person under the age of fourteen years is present and that the parent, guardian or any other person who has the lawful care or charge of the person under the age of fourteen years is not present;

1. Le paragraphe 161(1) du Code criminel est modifié par adjonction, après l’alinéa a), de ce qui suit :

a.1) de se trouver dans une maison d’habi-tation où le contrevenant sait ou devrait savoir qu’il s’y trouve une personne âgée de moins de quatorze ans, sans la présence du père, de la mère, du tuteur ou de toute autre personne ayant la garde ou la charge légale de celle-ci;
