Preamble
|
Whereas
recreational hunting and fishing have played an important role in shaping
Canada’s social, cultural and economic heritage;
Whereas recreational
hunters and anglers have made an important contribution to the understanding,
conservation, restoration and management of Canada’s fish and wildlife
resources;
And Whereas the best traditions of recreational hunting and fishing should be
valued by future generations;
Now, Therefore, Her Majesty, by
and with the advice and consent of the Senate and House of Commons of Canada,
enacts as follows:

Short title
|
1. This Act may be cited as the National Heritage Hunting and Fishing
Act.

4. (1) There is hereby established a Commission to be known as the
National Fish and Wildlife Heritage Commission.

(2) The Commission consists of
members appointed by the Governor in Council.

(3) The Governor in Council shall designate one of the
members of the Commission to be its Chair.

5. (1) The Commission shall, on the request of
the Minister, make recommendations to the Minister with respect to
(a)the promotion of practices that will lead future generations to
value recreational hunting and fishing;
(b)the promotion of public participation in fish and wildlife
conservation programs;
(c) the promotion of youth participation activities related to fish
and wildlife, including hunting and fishing;
(d)the promotion of tourism related to fish and wildlife, including
hunting and fishing;
(e) the promotion of new opportunities for activities related to fish
and wildlife, including hunting and fishing;
(f) the protection of Canada’s natural resources from the
introduction of species that are harmful or capable of causing harm to fish
or wildlife; and
(g)any other matter referred to the Commission by the Minister.

5. (1) À la demande du ministre, la Commis-sion lui fait des
recommandations concernant :
a) la promotion des pratiques qui
amèneront les générations futures à valoriser la chasse et la pêche
sportives;
b) la promotion de la participation
du public aux programmes de protection du poisson et de la faune;
c) la promotion de la participation
des jeunes aux activités liées au poisson et à la faune, y compris la chasse
et la pêche;
d) la promotion du tourisme axé sur
les activités liées au poisson et à la faune, y compris la chasse et la
pêche;
e) la promotion de nouvelles
possibilités d’activités liées au poisson et à la faune, y compris la chasse
et la pêche;
f) la protection des ressources
naturelles du Canada contre l’introduction d’espèces dommageables ou
susceptibles de nuire au poisson ou à la faune;
g) toute autre question que lui
renvoie le ministre.

(2) In making its recommendations under subsection (1),
the Commission shall be guided by the principle that natural resources are to
be protected, used and managed so as to supply benefits at optimal
sustainable levels for present and future generations of Canadians.
|

sur le principe qu’il faut protéger, utiliser et gérer les ressources
naturelles de manière à en faire bénéficier au maximum les Canadiens des

Financing of recommenda-tions
|
(3) At the request of the Minister, the Commission shall
make recommendations to the Minister on the design and establishment of a
mechanism to finance the matters referred to in subsection (1).

l’établissement d’un mécanisme de financement des activités recommandées aux
termes du paragraphe (1).

(4) The
Minister is not bound to act on any recommendation made under this section.
|

6. For greater certainty, nothing in this Act
shall be construed so as to abrogate or derogate from the protection provided
for existing aboriginal or treaty rights of the aboriginal peoples of Canada
by the recognition and affirmation of those rights in section 35 of the Constitution
Act, 1982.

existants — ancestraux ou issus de traités — des peuples
autochtones du Canada découlant de leur reconnaissance et de leur

7. (1) As soon as possible after the end of
each year, the Commission shall prepare and submit to the Minister a report
on the activities of the Commission during that year.

Tabling of report
|
(2) The Minister shall table the report in each House of
Parliament on any of the first fifteen days on which that House is sitting
after the Minister receives the report.
