This enactment amends the Canadian Human Rights Act to specify that it is a discriminatory practice to deny an individual access to goods, services, facilities or accommodation that are customarily available to the general public by prohibiting the entry of the individual’s assistance dog into any area where such goods, services, facilities or accommodation are accessible.

Le texte modifie la Loi canadienne sur les droits de la personne afin de qualifier d’acte discriminatoire le fait, pour le fournisseur de biens, de services, d’installations ou de moyens d’hébergement destinés au public, d’en priver un individu en interdisant l’entrée de son chien aidant dans le lieu où ils sont offerts.

The enactment further amends the Act to specify that it is a discriminatory practice to deny the trainer of a dog that is being trained to be an assistance dog access to any such area by prohibiting the entry of the dog into the area. It also amends the Act to specify that it is a discriminatory practice to deny an individual occupancy of residential or commercial premises because that individual uses an assistance dog.

D’autres modifications sont apportées afin de qualifier d’acte discriminatoire le fait de priver de l’accès à un tel lieu le dresseur d’un chien qui suit un entraînement de chien aidant en interdisant l’entrée du chien, ainsi que le fait de priver un individu de l’occupation de locaux commerciaux ou de logements pour le motif que celui-ci possède un chien aidant.

Her Majesty, by and with the advice and consent of the Senate and House of Commons of Canada, enacts as follows:

1. Section 5 of the Canadian Human Rights Act is renumbered as subsection 5(1) and is amended by adding the following:

1. L’article 5 de la Loi canadienne sur les droits de la personne devient le paragraphe 5(1) et est modifié par adjonction de ce qui suit :

Denial due to assistance dog

(2) For greater certainty and despite any other provision of this Act, it is a discriminatory practice under subsection (1) to

(a) deny an individual access to goods, services, facilities or accommodation that are customarily available to the general public by prohibiting the entry of the individual’s assistance dog into the area where such goods, services, facilities or accommodation are accessible, unless the prohibition is clearly necessary to protect public health or safety; or

(b) deny the trainer of a dog that is being trained to be an assistance dog access to any area where goods, services, facilities or accommodation that are customarily available to the general public by prohibiting the entry of the dog into any such area, unless the prohibition is clearly necessary to protect public health or safety. 

(2) Malgré toute autre disposition de la présente loi, constitue un acte discriminatoire au sens du paragraphe (1) le fait, pour le fournisseur de biens, de services, d’installations ou de moyens d’hébergement destinés au public :

a) d’en priver un individu en interdisant l’entrée de son chien aidant dans le lieu où ils sont offerts, sauf si l’interdiction est manifestement nécessaire pour protéger la santé ou la sécurité publiques;

b) d’en priver le dresseur d’un chien qui reçoit un entraînement de chien aidant, en interdisant l’entrée du chien dans le lieu où ils sont offerts, sauf si l’interdiction est manifestement nécessaire pour protéger la santé ou la sécurité publiques.

2. Section 6 of the Act is renumbered as subsection 6(1) and is amended by adding the following:

(2) For greater certainty, it is a discriminatory practice under subsection (1) to deny an individual occupancy of commercial premises or residential accommodation because that individual uses an assistance dog.

(2) Constitue un acte discriminatoire au sens du paragraphe (1) le fait, pour le fournisseur de locaux commerciaux ou de logements, de priver un individu de leur occupation pour le motif que celui-ci possède un chien aidant.

3. Section 25 of the Act is amended by adding the following in alphabetical order:

“assistance dog” means a dog that has been fully trained by a qualified animal trainer as a seeing-eye dog, a service dog, a seizure response dog or a seizure alert dog;
