Summary

Sommaire

The purpose of this enactment is to mandate the Chief  Statistician of Canada to transfer to the National Archivist of Canada all census information that has been collected since the 1906 census and that will be collected in every future census. Such transfer is currently prohibited. The National Archivist of Canada may make such information available to the public for research and statistical purposes provided that 92 years have elapsed since its collection.

Le texte enjoint au statisticien en chef du Canada de transférer à l’archiviste national du Canada tous les renseignements recueillis au moyen d’un recensement depuis le recensement de 1906 ainsi que ceux qui le seront à l’avenir. Un tel transfert est actuellement interdit. L’archiviste national du Canada peut mettre de tels renseignements à la disposition du public pour des travaux de recherche ou de statistique, à la condition qu’une période d’au moins 92 ans se soit écoulée depuis le recensement.

1. Section 4 of the National Archives of Canada Act is amended by adding the following after subsection (4):

1. L’article 4 de la Loi sur les Archives nationales du Canada est modifié par adjonction, après le paragraphe (4), de ce qui suit :

Release of census information

(5) Despite any other provision in this Act or any other Act of Parliament or a regulation made thereunder, the Archivist may disclose to any person or body for research or statistical purposes any information under the control of the Archivist that is contained in a census of population taken before or after the coming into force of this section, provided that 92 years have elapsed since the census containing the information was taken.

(5) Malgré toute autre disposition de la présente loi, de toute autre loi fédérale ou de leurs règlements, l’archiviste peut commu-niquer à toute personne ou à tout organisme pour des travaux de recherche ou de statistique les renseignements qui ont été placés sous son contrôle et qui ont été obtenus au moyen d’un recensement de la population tenu avant ou après l’entrée en vigueur du présent article, à la condition qu’une période d’au moins 92 ans se soit écoulée depuis le recensement.

2. The Statistics Act is amended by adding the following after section 21:

Transfer of census information obtained after 1906 but before this section comes into force

21.1 (1) Despite any other provision in this Act or any other Act of Parliament or a regulation made thereunder, the Chief Statistician shall, not later than 30 days after the day this section comes into force, transfer to the National Archivist for archival purposes, the information contained in every census of population taken in Canada after 1906 but prior to the coming into force of this section.

21.1 (1) Malgré toute autre disposition de la présente loi, de toute autre loi fédérale ou de leurs règlements, le statisticien en chef transfert, au plus tard 30 jours après l’entrée en vigueur du présent article, à l’archiviste national aux fins d’archives, les renseigne-ments obtenus au moyen de tout recensement de la population tenu au Canada après 1906 mais avant l’entrée en vigueur du présent article.

Transfer of census information obtained after this section comes into force

(2) Despite any other provision in this Act or any other Act of Parliament or a regulation made thereunder, the Chief Statistician shall, not later than five years following every census taken in Canada after the coming into force of this section,  transfer the information contained in that census to the National Archivist for archival purposes.

(2) Malgré toute autre disposition de la présente loi, de toute autre loi fédérale ou de leurs règlements, le statisticien en chef transfert, dans les cinq ans suivant tout recensement tenu au Canada après l’entrée en vigueur du présent article, les renseignements obtenus au moyen de ce recensement à l’archiviste national aux fins d’archives.
