SUMMARY
This enactment amends the Canada Disability Benefit Act to provide that a person’s eligibility for a benefit under that Act must not be affected by their eligibility for other such benefits, their marital status or their household income.

An Act to amend the Canada Disability Benefit Act |
His Majesty, by and with the advice and consent of the Senate and House of Commons of Canada, enacts as follows:

Canada Disability Benefit Act
1 Section 4 of the Canada Disability Benefit Act is renumbered as subsection 4(1) and is amended by adding the following:
Eligibility — excluded factors
Start of inserted block(2) A person’s receipt of a disability benefit under an Act of the legislature of a province, their marital status or their household income must not be considered in determining their eligibility for a benefit under this Act or in reducing such a benefit.
End of inserted block2 Section 11 of the Act is amended by adding the following after subsection (1):
Regulations — household income
Start of inserted block(1.01) Regulations made under any of paragraphs (1)(a) to (c) must provide that any criteria, conditions or amounts are to be determined based on the income of the person to whom an application for a benefit relates, not on their household income.
