SUMMARY

This enactment amends the Territorial Lands Act to authorize the Governor in Council to make regulations for the acquisition of mining rights in, under or on territorial lands and to require that any such regulations must provide for the free, prior and informed consent of Inuit and of any other Indigenous peoples who would be directly affected.

His Majesty, by and with the advice and consent of the Senate and House of Commons of Canada, enacts as follows:

Territorial Lands Act

1Section 12 of the Territorial Lands Act is replaced by the following:

Acquisition of mining rights

12The Governor in Council may make regulations for the Insertion start acquisition Insertion end of mining rights in, under or on territorial lands and the payment of royalties Insertion start in respect of the acquisition Insertion end , but such regulations shall
  • Start of inserted block

    (a)provide that any such acquisition requires the free, prior and informed consent of Inuit and of any other Indigenous peoples who would be directly affected by it; and

    End of inserted block
  • Insertion start (b) Insertion end provide for the protection of and compensation to the holders of surface rights.
