SOMMAIRE

Le texte modifie le Code criminel afin d’interdire la communication de déclarations, autrement que dans une conversation privée, qui fomentent volontairement l’antisémitisme en cautionnant, en niant ou en minimisant l’Holocauste.

SUMMARY

This enactment amends the Criminal Code in order to prohibit the communication of statements, other than in private conversation, that wilfully promote antisemitism by condoning, denying or downplaying the Holocaust.

1 (1) L’article 319 du Code criminel est modifié par adjonction, après le paragraphe (2), de ce qui suit :

1 (1) Section 319 of the Criminal Code is amended by adding the following after subsection (2):

Fomenter volontairement l’antisémitisme

Wilful promotion of antisemitism

(2.‍1) Quiconque, par la communication de déclarations autrement que dans une conversation privée, fomente volontairement l’antisémitisme en cautionnant, en niant ou en minimisant l’Holocauste, est coupable :

a) soit d’un acte criminel passible d’un emprisonnement maximal de deux ans;

b) soit d’une infraction punissable sur déclaration de culpabilité par procédure sommaire.

(2.‍1) Everyone who, by communicating statements, other than in private conversation, wilfully promotes antisemitism by condoning, denying or downplaying the Holocaust is

(a) guilty of an indictable offence and liable to imprisonment for a term not exceeding two years; or

(b) guilty of an offence punishable on summary conviction.

(4) Lorsqu’une personne est déclarée coupable d’une infraction prévue à l’article 318 ou aux paragraphes (1), (2) ou (2.‍1) du présent article, le juge de la cour provinciale ou le juge qui préside peut ordonner que toutes choses au moyen desquelles ou en liaison avec lesquelles l’infraction a été commise soient, outre toute autre peine imposée, confisquées au profit de Sa Majesté du chef de la province où cette personne a été reconnue coupable, pour qu’il en soit disposé conformément aux instructions du procureur général.

(4) If a person is convicted of an offence under section 318 or subsection (1), (2) or (2.‍1) of this section, anything by means of or in relation to which the offence was committed, on conviction, may, in addition to any other punishment imposed, be ordered by the presiding provincial court judge or judge to be forfeited to Her Majesty in right of the province in which that person is convicted, for disposal as the Attorney General may direct.

(6) No proceeding for an offence under subsection (2) or (2.‍1) shall be instituted without the consent of the Attorney General.

(4) Le paragraphe 319(7) de la même loi est modifié par adjonction, selon l’ordre alphabétique, de ce qui suit :

(4) Subsection 319(7) of the Act is amended by adding the following in alphabetical order:

Holocauste Persécution et anéantissement, avec prémiditation et de propos délibéré, des Juifs européens par les nazis et leurs collaborateurs, sur commande de l’État, de 1933 à 1945. (Holocaust)

Holocaust means the planned and deliberate state-sponsored persecution and annihilation of European Jewry by the Nazis and their collaborators from 1933 to 1945; (Holocauste)
