In accordance with the order of reference adopted by the Senate on Thursday, March 3, 2022 and the motion of the House of Commons of Wednesday, March 3, 2022, the Special Joint Committee on the Declaration of Emergency has the honour to present its interim report.

Pursuant to section 62(1) of the Emergencies Act, and the abovementioned order of reference and motion, the Special Joint Committee on the Declaration of Emergency (the committee) held its first meeting on Monday, March 14, 2022. Since then, the committee has continued its review of the exercise of powers and the performance of duties and functions pursuant to the declaration of emergency that was in effect from Monday, February 14, 2022, to Wednesday, February 23, 2022. The committee has held a total of 30 meetings, during which it heard from a range of stakeholders and government representatives.

The committee’s work coincided with the Public Order Emergency Commission (also known as the Rouleau Commission), pursuant to section 63(1) of the Emergencies Act. The Rouleau Commission released its final Report of the Public Inquiry into the 2022 Public Order Emergency on February 17, 2023.

In order to make its work more efficient, on Thursday, September 22, 2022, the committee agreed to deem the evidence of the Rouleau Commission – including testimony and documents received by, and published on, the website of the Commission – to have been received by the committee. The committee notes that not all of the evidence of the Commission is available in both official languages.

As such, in its meeting of Tuesday, June 13, 2023, the committee agreed to suspend its work until all the documents produced before the Rouleau Commission are translated and made available to the members of the committee in both official languages. Since then, the committee has been engaged in an ongoing dialogue with the Privy Council Office and the Translation Bureau, to receive the translation of requested indexes and a subset of selected documents in both official languages. On Tuesday, April 30, 2024, the committee agreed to resume its review of the draft substantive report, not excluding the ability to revisit any new information as presented in the forthcoming translated documents.

The committee intends to table its final substantive report at a later date.
