SOMMAIRE
Le texte modifie le Code criminel afin d’ériger en infraction le fait d’intimider un médecin, un infirmier praticien, un pharmacien ou tout autre professionnel de la santé dans le dessein de le forcer à prendre part, directement ou indirectement, à la prestation de l’aide médicale à mourir.
Il érige également en infraction le fait de congédier ou de refuser d’employer un médecin, un infirmier praticien, un pharmacien ou tout autre professionnel de la santé pour la seule raison qu’il refuse de prendre part, directement ou indirectement, à la prestation de l’aide médicale à mourir.
SUMMARY
This enactment amends the Criminal Code to make it an offence to intimidate a medical practitioner, nurse practitioner, pharmacist or other health care professional for the purpose of compelling them to take part, directly or indirectly, in the provision of medical assistance in dying.
It also makes it an offence to dismiss from employment or to refuse to employ a medical practitioner, nurse practitioner, pharmacist or other health care professional for the reason only that they refuse to take part, directly or indirectly, in the provision of medical assistance in dying.

Attendu :
que chacun a la liberté de conscience et de religion aux termes de l’article 2 de la Charte canadienne des droits et libertés;
que le Parlement considère qu’il est dans l’intérêt public de protéger la liberté de conscience d’un médecin, d’un infirmier praticien, d’un pharmacien et de tout autre professionnel de la santé qui refuse de prendre part, directement ou indirectement, à la prestation de l’aide médicale à mourir;
qu’un régime qui obligerait un médecin, un infirmier praticien, un pharmacien ou tout autre professionnel de la santé à assurer l’aiguillage efficace des patients pourrait porter atteinte à la liberté de conscience des professionnels de la santé,
Preamble
Whereas everyone has freedom of conscience and religion under section 2 of the Canadian Charter of Rights and Freedoms;
Whereas Parliament considers that it is in the public interest to protect the freedom of conscience of a medical practitioner, nurse practitioner, pharmacist or other health care professional who objects to taking part, directly or indirectly, in the provision of medical assistance in dying;
And whereas a regime that would require a medical practitioner, nurse practitioner, pharmacist or other health care professional to provide effective referral to patients could infringe on the freedom of conscience of health care professionals;

241.5 (1) Quiconque, dans le dessein de forcer un médecin, un infirmier praticien, un pharmacien ou tout autre professionnel de la santé à prendre part, directement ou indirectement, à la prestation de l’aide médicale à mourir, use de violence ou de menaces de violence, de contrainte ou de toute autre forme d’intimidation est coupable :
a) soit d’un acte criminel passible d’un emprisonnement maximal de cinq ans;
b) soit d’une infraction punissable sur déclaration de culpabilité par procédure sommaire.
End of inserted block241.5 (1) Every person who, for the purpose of compelling a medical practitioner, nurse practitioner, pharmacist or other health care professional to take part, directly or indirectly, in the provision of medical assistance in dying, uses violence or threats of violence, coercion or any other form of intimidation, is guilty of
(a) an indictable offence and liable to imprisonment for a term of not more than five years; or
(b) an offence punishable on summary conviction.
