Pursuant to the order of the Senate of February 8, 2021, the Standing Joint Committee for the Scrutiny of Regulations met this day by videoconference at 12:35 p.m. [ET], the joint chairs, the Honourable Senator Yuen Pau Woo and Mr. Dean Allison, presiding. This meeting is considered to have taken place in the parliamentary precinct.

Representing the Senate by videoconference: The Honourable Senators Saint-Germain, Seidman, White and Woo (4).

Representing the House of Commons by videoconference: Dean Allison, Vance Badaway, Élisabeth Brière, Blaine Calkins, Scot Davidson, Caroline Desbiens, Fayçal El-Khoury, Helena Jaczek (for Vance Badaway), Alistair MacGregor, Dave MacKenzie, Robert J. Morrissey, and Scott Simms (12).

The committee proceeded to consider its permanent order of reference, as set out in section 19, the Statutory Instruments Act, R.S.C., 1985, c. S-22, which provides for the following:

Every statutory instrument issued, made or established after December 31, 1971, other than an instrument the inspection of which and the obtaining of copies of which are precluded by any regulations made pursuant to paragraph 20(d), shall stand permanently referred to any Committee of the House of Commons, of the Senate or of both Houses of Parliament that may be established for the purpose of reviewing and scrutinizing statutory instruments.

In the matter of SOR/2018-71 Regulations Amending the Insurable Earnings and Collection of Premiums Regulations, it was agreed that the joint chairs correspond with the Minister of National Revenue with respect to certain comments made by the committee.

In the matter of SOR/97-6 Feeds Regulations, 1983, amendment, it was agreed that counsel to the committee correspond with the Designated Instruments Officer of the Canadian Food Inspection Agency with respect to certain comments made by the committee.

In the matter of SOR/2018-135 Regulations Amending the Special Economic Measures (Burma) Regulations, it was agreed that the file be closed.

In the matter of SOR/2013-221 Electronic Commerce Protection Regulations, it was agreed that counsel to the committee correspond with the Designated Instruments Officer of the Department of Innovation, Science and Economic Development with respect to certain comments made by the committee.

In the matter of SOR/2016-252 Regulations Amending the Prohibition of Certain Toxic Substances Regulations, 2012, it was agreed that counsel to the committee correspond with the Designated Instruments Officer of Environment Canada with respect to certain comments made by the committee.

The committee considered SOR/2018-275 Regulations Amending the Canada Education Savings Regulations.

In the matter of SI/2018-61 Order Designating the Department of Employment and Social Development to provide support to the Minister of Seniors, and SI/2018-62 Order designating the Department of Public Safety and Emergency Preparedness to provide support to the Minister of Border Security and Organized Crime Reduction, it was agreed that the file be closed.

In the matter of SI/2018-65 Order Assigning the Honourable Carla Qualtrough, a Minister of State to assist the Minister of Employment and Social Development, it was agreed that the file be closed.

In the matter of SI/2018-86 Order designating the Minister of Public Works and Government Services for the purposes of section 23 of the Public Service Employment Act, it was agreed that the file be closed.

In the matter of SI/2019-55 Order Fixing July 11, 2019 as the Day on which that Act comes into Force, it was agreed that the file be closed.

In the matter of SOR/2002-227 Immigration and Refugee Protection Regulations as amended to SOR/20015-61, it was agreed that counsel to the committee correspond with the Designated Instruments Officer of the Canada Border Services Agency and Immigration, Refugees and Citizenship Canada with respect to certain comments made by the committee.

In the matter of SI/2019-24 Withdrawal from Disposal of Certain Tracts of Territorial Lands in Nunavut (Hans Island) Order, it was agreed that the file be closed.

In the matter of SOR/2018-220 Regulations Amending the Crown Corporation General Regulations, 1995, it was agreed that the file be closed.
