SOMMAIRE

Le texte prévoit l’élaboration d’un cadre fédéral ayant pour objet la dissuasion et la prévention relativement à la distraction au volant. Il prévoit en outre des exigences en matière de consultation, d’examen et de reddition de comptes à l’égard du cadre.

SUMMARY

This enactment provides for the development of a federal framework to deter and prevent distracted driving. It also sets out consultation, review and reporting requirements in relation to the framework.

3 (1) Le ministre, en collaboration avec le ministre des Transports et les gouvernements provinciaux, élabore un cadre fédéral afin de coordonner et d’appuyer le travail des provinces en matière de dissuasion et de prévention relativement à la distraction au volant attribuable à l’utilisation d’appareils électroniques portatifs, notamment les appareils de communication et de navigation.

3 (1) The Minister must, in collaboration with the Minister of Transport and the provincial governments, develop a federal framework to coordinate and promote efforts in the provinces to deter and prevent distracted driving involving the use of hand-held electronic devices, including communication devices and navigation devices.

(2) Le cadre traite de chacun des éléments qui suivent :

  • a) la collecte de renseignements et de statistiques sur les accidents causés par la distraction au volant attribuable à l’utilisation d’appareils électroniques portatifs;

  • b) l’exécution et le contrôle d’application des lois concernant ce type de distraction au volant;

  • c) l’élaboration et la mise en œuvre de programmes de sensibilisation du public comme outil de dissuasion relativement à la distraction au volant;

  • d) le rôle des technologies d’aide à la conduite dans la réduction du nombre d’accidents causés par la distraction au volant;

  • e) la mise en commun, par les provinces, de pratiques exemplaires en matière de dissuasion et de prévention;

  • f) la formulation de recommandations sur les modifications qui pourraient être apportées aux lois, politiques et programmes fédéraux.

(2) The framework must cover all of the following elements:

  • (a) the collection of information and statistics relating to incidents that occur as a result of distracted driving involving the use of hand-held electronic devices;

  • (b) the administration and enforcement of laws respecting such distracted driving;

  • (c) the creation and implementation of public education programs to deter distracted driving;

  • (d) the role of driver-assistance technology in reducing the number of incidents that occur as a result of distracted driving;

  • (e) the sharing among the provinces of best practices regarding deterrence and prevention;

  • (f) recommendations regarding possible amendments to federal laws, policies and programs.

(3) Pour l’élaboration du cadre fédéral, le ministre consulte des intervenants et d’autres intéressés, notamment des représentants de corps de police, d’associations d’automobilistes, de constructeurs de véhicules et de compagnies d’assurance.

(3) In developing the federal framework, the Minister must consult with stakeholders and other interested parties, including representatives of police services, automobile associations, vehicle manufacturers and insurance companies.

4 (1) Dans les dix huit mois suivant la date d’entrée en vigueur de la présente loi, le ministre établit un rapport énonçant le cadre fédéral et il le fait déposer devant chaque chambre du Parlement dans les quinze premiers jours de séance de celle-ci suivant son achèvement.

4 (1) Within 18 months after the day on which this Act comes into force, the Minister must prepare a report setting out the federal framework and cause it to be tabled in each House of Parliament on any of the first 15 days on which that House is sitting after it is completed.

(2) Il publie le rapport sur le site Web du ministère de la Justice dans les trente jours suivant la date de son dépôt devant les deux chambres du Parlement.

(2) The Minister must publish the report on the Department of Justice’s website within 30 days after it has been tabled in both Houses of Parliament.

5 (1) Dans les trois ans suivant le dépôt du rapport prévu à l’article 4 devant les deux chambres du Parlement, le ministre, en consultation avec les gouvernements des provinces et les intervenants et autres intéressés visés au paragraphe 3(3), procède à un examen approfondi de la mise en œuvre et de l’efficacité du cadre fédéral dans chaque province, puis il établit un rapport faisant état de ses conclusions et recommandations.

5 (1) Within three years after the report referred to in section 4 has been tabled in both Houses of Parliament, the Minister must, in consultation with the provincial governments and the parties referred to in subsection 3(3), undertake a comprehensive review of the implementation and effectiveness of the federal framework in each province, and prepare a report setting out his or her findings and recommendations.

(2) Le ministre fait déposer le rapport d’examen devant chaque chambre du Parlement dans les quinze premiers jours de séance de celle-ci suivant son achèvement.

(2) The Minister must cause the report of the review to be tabled in each House of Parliament on any of the first 15 days on which that House is sitting after it is completed.
