SUMMARY

This enactment amends Part 9 of the Canada Shipping Act, 2001 to prohibit the transportation of oil in oil tankers in the Queen Charlotte Sound, Hecate Strait and Dixon Entrance.

Preamble

Whereas British Columbia’s North Coast comprises a unique and diverse ocean ecosystem whose marine resources sustain regional economies in British Columbia;

Whereas the lands and waters on the North Coast hold crucial cultural and historic importance for the communities and First Nations who call the North Coast home;

Whereas governments and industry have ignored the moratorium on oil tanker traffic on British Columbia’s North Coast with impunity;

And whereas it is long past time that Canada’s laws governing British Columbia’s North Coast be brought into line with the laws of coastal First Nations;

Now, therefore, Her Majesty, by and with the advice and consent of the Senate and House of Commons of Canada, enacts as follows:

1This Act may be cited as the Protection of the North Coast of British Columbia Act.

2The Canada Shipping Act, 2001 is amended by adding the following after section 189:

189.‍1The following definitions apply in this section and in section 189.‍2.

oil has the same meaning as in section 2 of the Canada Oil and Gas Operations Act. (pétrole)

oil tanker means a vessel that is constructed or adapted primarily to transport oil in bulk in a hold or tank that is part of its structure, without any intermediate form of containment. (pétrolier)

189.‍2(1)It is prohibited to transport oil in an oil tanker in the areas of the sea that are adjacent to the coast of Canada known as the North Coast of British Columbia and that include Queen Charlotte Sound, Hecate Strait and Dixon Entrance, as described in Schedule 4.

(2)The prohibition in subsection (1) does not apply in respect of the transportation of gasoline, aviation fuel, diesel oil or fuel oil that is intended for use in coastal and island communities in Canada.

3Subsection 191(1) of the Act is amended by striking out “and” at the end of paragraph (c) and by adding the following after that paragraph:

4The Act is amended by adding, after Schedule 3, the Schedule 4 set out in the schedule to this Act.
