SUMMARY
This enactment amends the Aeronautics Act to provide that the Governor in Council may make regulations respecting the location of aerodromes only with the approval of the provincial authority.
It also provides that the Governor in Council may make regulations preventing lands adjacent to or in the vicinity of an airport or an airport site from being used or developed only if the relevant minister has been unable to reach an agreement with the government of the province in which the lands are located.

R.S., c. A-2
Her Majesty, by and with the advice and consent of the Senate and House of Commons of Canada, enacts as follows:
1. Paragraph 4.9(e) of the Aeronautics Act is replaced by the following:
(e) activities at aerodromes and the inspection, certification, registration, licensing and operation of aerodromes;
(e.1) the location of aerodromes, with the approval of the provincial authority, as defined in subsection 5.4(1);
2. Subsection 5.4(3) of the Act is replaced by the following:
Conditions precedent
(3) The Governor in Council shall not make a zoning regulation under subsection (2) unless
(a) the Minister, after making a reasonable attempt to do so, has been unable to reach an agreement with the government of the province in which the lands to which the zoning regulation applies are situated providing for a use or development of the lands in a manner that complies with the provisions of subsection (2); or
(b) in the opinion of the Minister, it is necessary to immediately prevent a use or development of the lands to which the zoning regulation applies in a manner that is contrary to the provisions of subsection (2).
