SUMMARY
This enactment amends the Divorce Act to provide that, in the case of a former spouse who is terminally ill or in critical condition, the court shall make a variation order in respect of access that is in the best interests of the child.

R.S., c. 3 (2nd Supp.)
Her Majesty, by and with the advice and consent of the Senate and House of Commons of Canada, enacts as follows:
1. Section 17 of the Divorce Act is amended by adding the following after subsection (5):
Variation order
(5.1) For the purposes of subsection (5), a former spouse's terminal illness or critical condition shall be considered a change of circumstances of the child of the marriage, and the court shall make a variation order in respect of access that is in the best interests of the child.
