An Act to amend the Pest Control Products Act (prohibition of use of chemical pesticides for non-essential purposes)
|
|
|
WHEREAS many chemical pesticides have been shown to be harmful to humans and domestic animals and some are carcinogenic;
|
|
|
WHEREAS the use of chemical pesticides on home lawns and gardens and on recreational facilities such as parks and golf courses is particularly hazardous because of the likelihood of immediate and continuing use of the land by, and thus exposure of the chemical pesticide to, the residents of the home and users of the recreational facilities, who may include children, pregnant women and others who may be particularly sensitive, and domestic animals;
|
|
|
WHEREAS such home and recreational use of pesticides tends to utilize heavier application rates than agricultural use;
|
|
|
WHEREAS chemical pesticides have only been used for home and recreational facilities for a relatively short period of time and other non-toxic methods of pest and weed control have been used in the past and are still available;
|
|
|
WHEREAS any advantage of such use of chemical pesticides is outweighed by the health and environmental risks;
|
|
|
AND WHEREAS more research is needed to determine which chemical pesticides are safe for home and recreational use;
|
|
|

Attendu :

qu’il est démontré que de nombreux pesticides chimiques sont nocifs pour les êtres humains et les animaux domestiques et que certains de ces produits sont cancérogènes;
|
|
|
|
que l’utilisation de pesticides chimiques sur les gazons et dans les jardins des maisons d’habitation ainsi que dans les lieux récréatifs, tels les parcs et les terrains de golf, constitue un danger particulièrement sérieux du fait que les habitants des maisons et les utilisateurs des lieux récréatifs — notamment les enfants, les femmes enceintes et autres personnes pouvant présenter une sensibilité particulière —, ainsi que les animaux domestiques, encourent un risque d’exposition à ces pesticides résultant de l’usage direct et continu de ces lieux;
|
|
|
|
que les doses de pesticides pour usage domestique et récréatif tendent à être plus élevées que pour l’usage agricole;
|
|
|
|
que l’utilisation de pesticides chimiques à des fins domestiques et récréatives est relativement récente et que d’autres moyens non toxiques de lutte contre les parasites et les mauvaises herbes ont été employés auparavant et sont toujours disponibles;
|
|
|
|
que les risques que l’utilisation de ces produits présente pour la santé et l’environnement l’emportent sur les avantages qui en découlent;
|
|
|
|
qu’il est essentiel de mener des recherches plus poussées pour établir quels pesticides chimiques peuvent être utilisés sans danger à des fins domestiques et récréatives,
|
|
|
|
|
|
NOW, THEREFORE, Her Majesty, by and with the advice and consent of the Senate and House of Commons of Canada, enacts as follows:
|
|

1. The Pest Control Products Act is amended by adding the following after section 6:
|
|
|
|

6.01 (1) Beginning on the 22nd day of April (“Earth Day”) next following the coming into force of this section, no regulation made pursuant to this Act shall apply to the use of a control product
|
|
|
|
(a) within a dwelling-house;
|
|
|
|
(b) on any parcel of land on which a dwelling-house is situated;
|
|
|
|
(c) on any place that is within one hundred metres of a parcel of land described in paragraph (b);
|
|
|
|
(d) in any school, hospital, office or similar building in which members of the public customarily stay for more than a day or work; or
|
|
|
|
(e) on any private or public land that is customarily used by members of the public as visitors, licensees or in any other authorized capacity for recreation or entertainment, including but not limited to parks and sports grounds.

|
|
6.01 (1) À compter du 22 avril (« Jour de la Terre ») suivant l’entrée en vigueur du présent article, aucun règlement pris en vertu de la présente loi ne peut s’appliquer à l’utilisation d’un produit antiparasitaire :

b) sur un terrain où est située une maison d’habitation;
|

c) dans tout lieu situé dans un rayon de cent mètres d’un terrain visé à l’alinéa b);

d) à l’intérieur de tout hôpital, école, bureau ou bâtiment semblable dans lequel des membres du public demeurent habituellement pendant plus d’une journée ou travaillent habituellement;
|
|
|
|
e) sur tout terrain privé ou public –– notamment les parcs et les terrains de sport –– qu’utilisent habituellement les membres du public, en tant que visiteurs ou titulaires d’un permis ou autre autorisation, à des fins récréatives ou de divertissement.

(2) Paragraph (1)(c) does not apply to a building used for the husbandry of animals, the cultivation of plants or the storage, processing, packaging or distribution of plants or animals or products made primarily from plants or animals, or in the immediate vicinity of such a building.
|
|
|
|
(2) L’alinéa (1)c) ne s’applique pas aux bâtiments servant à l’élevage d’animaux, la culture de végétaux ou l’entreposage, la transformation, l’emballage ou la distribution de végétaux ou d’animaux ou de produits qui en sont principalement dérivés, ni au voisinage immédiat de ces bâtiments.

|
(3) Subsection (1) does not apply to a regulation made on or after the 22nd day of April next following the coming into force of this section that approves the use of a control product in a place mentioned in subsection (1) if, before the regulation comes into effect,
|
|
|
|
(a) the Minister of Health has laid before each House of Parliament a draft of the proposed regulation and the scientific and medical evidence on the basis of which the use of the control product in such a place has been determined to be safe for the health of humans and domestic animals that customarily reside in dwelling-houses; and
|
|
|
|
(b) the proposed regulation and the scientific and medical evidence have been referred to a standing committee of the House of Commons, and the standing committee has reported to the House its opinion that the proposed use of the control product in question is justified by the scientific and medical evidence.
|
|
|
|
(3) Est soustrait à l’application du paragraphe (1) tout règlement, pris le 22 avril suivant l'entrée en vigueur du présent article ou après cette date, qui autorise l’utilisation d’un produit antiparasitaire dans un lieu mentionné à ce paragraphe si, avant son entrée en vigueur, les conditions suivantes ont été remplies :

a) le ministre de la Santé a déposé devant chaque chambre du Parlement le projet de ce règlement ainsi que la preuve scientifique et médicale démontrant que l’utilisation du produit antiparasitaire dans ce lieu ne présente aucun danger pour la santé des êtres humains et des animaux domestiques qui demeurent habituellement dans des maisons d’habitation;

|
|
b) le projet de règlement ainsi que la preuve scientifique et médicale ont été renvoyés devant un comité permanent de la Chambre des communes et ce comité a présenté à la Chambre un rapport concluant que la preuve justifie l’utilisation projetée du produit antiparasitaire.

Coming into force
|
|
3. Section 2 of this Act comes into force on the day on which section 67 of the Pest Control Products Act, chapter 28 of the Statutes of Canada, 2002, comes into force.
|
