The Standing Joint Committee for the Scrutiny of Regulations met this day at 8:33 a.m. in room 256-S of the Centre Block, the Joint Chairs, the Honourable Senator J. Trevor Eyton and Mr.Paul Szabo, M.P., presiding.

Representing the Senate: The Honourable Senators Bryden, DeBané, P.C., Eyton, Moore and Nolin (5).

Representing the House of Commons: France Bonsant, Ken Epp, Derek Lee, John Maloney, Rick Norlock and Paul Szabo (6).

Also present: Mike Macpherson, Joint Clerk of the Committee (House of Commons); from the Parliamentary Research Branch of the Library of Parliament: Peter Bernhardt, General Counsel, and Jacques Rousseau, Counsel.

In attendance: The official reporters of the Senate.

The committee continued to examine its permanent Order of Reference as set out in section19 of the Statutory Instruments Act, R.S.C. (1985), c. S-22, which provides for the following:

Every statutory instrument issued, made or established after December31, 1971, other than an instrument the inspection of which and the obtaining of copies of which are precluded by any regulations made pursuant to paragraph20(d), shall stand permanently referred to any committee of the House of Commons, of the Senate or of both Houses of Parliament that may be established for the purpose of reviewing and scrutinizing statutory instruments.

The committee considered the Parks Canada Master List of Fees 2003-2004.

On SOR/2005-241 — Regulations Amending the Gun Shows Regulations; SOR/2005-242 — Regulations Amending the Firearms Marking Regulations, it was agreed that Counsel to the committee would correspond with the Designated Instruments Officer of the Royal Canadian Mounted Police with respect to certain comments made by the committee.

On SOR/2005-380 — Decision Body Time Periods and Consultation Regulations, it was agreed that Counsel to the committee would correspond with the Designated Instruments Officer of Indian and Northern Affairs Canada with respect to certain comments made by the committee.

On SOR/2006-60 — Order Amending Schedules 1 to 3 to the Species at Risk Act, it was agreed that the file be closed.

On SOR/97-6 — Feeds Regulations, 1993, amendment; SOR/97-9 — Seeds Regulations, amendment; SOR/2001- 274 — Regulations Amending the Seeds Regulations, amendment, it was agreed that Counsel to the committee would correspond with the Designated Instruments Officer of the Canadian Food Inspection Agency with respect to certain comments made by the committee.

On SOR/2006-188 — Regulations Amending the Canada Lands Surveyors Regulations, it was agreed that Counsel to the committee would correspond with the Designated Instruments Officer of Natural Resources Canada with respect to certain comments made by the committee.

On SOR/2006-242 — Regulations Amending the Patented Medicines (Notice of Compliance) Regulations, it was agreed that Counsel to the committee would correspond with the Designated Instruments Officer of Industry Canada with respect to certain comments made by the committee.

On SOR/91-570 — Energy Monitoring Regulations, amendment, it was agreed that Counsel to the committee would correspond with the Designated Instruments Officer of Natural Resources Canada with respect to certain comments made by the committee.

On SORS/94-34 — Aviation Occupational Safety and Health Regulations, amendment, it was agreed that Counsel to the committee would correspond with the Designated Instruments Officer of Human Resources and Social Development Canada with respect to certain comments made by the committee.

On SOR/2003-319 — Regulations Amending the Sulphur in Gasoline Regulations, it was agreed that Counsel to the committee would correspond with the Designated Instruments Officer of Environment Canada with respect to certain comments made by the committee.

On SOR/91-365 — Pari-Mutuel Betting Supervision Regulations, it was agreed that Counsel to the committee would correspond with the Designated Instruments Officer of the Department of Justice with respect to certain comments made by the committee.

On SOR/2000-187 — Agriculture and Agri-Food Administrative Monetary Penalties Regulations; SOR/2002-183 — Regulations Amending the Agriculture and Agri-Food Administrative Monetary Penalties Regulations; SOR/2003- 256 — Regulations Amending the Agriculture and Agri-Food Administrative Monetary Penalties Regulations, it was agreed that Counsel to the committee would correspond with the Designated Instruments Officer of the Canadian Food Inspection Agency with respect to certain comments made by the committee.

On SOR/2002-307 — Marine Liability Regulations, it was agreed that Counsel to the committee would correspond with the Designated Instruments Officer of Transport Canada with respect to certain comments made by the committee.

On SOR/2003-241 — Regulations Amending the Customs Bonded Warehouses Regulations, it was agreed that Counsel to the committee would correspond with the Designated Instruments Officer of the Canadian Border Services Agency with respect to certain comments made by the committee.

On SOR/2004-274 — Regulations Amending the Firearms Licences Regulations, it was agreed that Counsel to the committee would correspond with the Designated Instruments Officer of the Royal Canadian Mounted Police with respect to certain comments made by the committee.

On SOR/2005-373 — Political Activities Regulations, it was agreed that Counsel to the committee would correspond with the Designated Instruments Officer of the Public Service Commission of Canada with respect to certain comments made by the committee.
