This enactment provides that a member’s seat in the House of Commons will be vacated and a by-election called for that seat if the member, having been elected to the House as a member of a political party or as an independent, changes parties in the House or becomes a member of a party in the House, as the case may be, at any time during the term for which he or she was elected. A member’s seat will not be vacated if the member, having been elected as a member of a political party, chooses to sit as an independent at any time during the term for which he or she was elected. |

texte prévoit que le siège d’un député devient vacant –– cette vacance ayant
pour conséquence le déclenchement d’une élection partielle –– si le député,

1. The Parliament of Canada Act is amended by adding the following after section 30: |

30.1 (1) If any member of the House of Commons
crosses the floor of that House, the member’s seat is thereby vacated and the
member’s election to the House is void. |

Interpretation |
(2) For the purposes of this section, a member of the House of Commons crosses the floor of that House if (a) the member ceases to sit among the members of the House belonging to the party that endorsed the member’s candidacy in the election in which the member was returned to the House and commences to sit, at any time during the term for which he or she was elected, among members of the House belonging to another party in the House; or (b) the member, having been elected as an independent in the election that returned the member to the House, ceases to sit as an independent and commences to sit, at any time during the term for which he or she was elected, among members of the House belonging to any party in the House. |

(2) Pour

(3) If a member of the House of Commons crosses the floor of that House, the leader of that party that receives the member shall, without delay and in writing, notify the Speaker that the member has crossed the floor of the House. |

(4) If a vacancy occurs in the House of Commons by reason of the fact that a member has crossed the floor of that House, the Speaker of the House shall, without delay, on receipt of a notice under subsection (3), address a warrant of the Speaker to the Chief Electoral Officer for the issue of a writ for the election of a member to fill the vacancy. |

(4) En
cas de vacance à la Chambre des communes par suite du changement
d’appartenance politique d’un député, le président, dès réception de l’avis
mentionné au paragraphe (3), adresse au directeur général des élections

(5) If, when a vacancy occurs as described in subsection (4), or at any time thereafter, before the warrant of the Speaker for a writ has issued, there is no Speaker of the House or the Speaker is absent from Canada, the leader of a party referred to in subsection (3) shall address his or her warrant, under his or her hand and seal, to the Chief Electoral Officer for the issue of a writ for the election of a member to fill the vacancy. |

(5) Si, au moment où survient à la

(7) For the purposes of this section, a
member of the House of Commons belongs to a party in the House of Commons
where he or she is recognized by the party as belonging to that party. |
