Sommaire

The purpose of this enactment is to amend the Canada Elections Act in order to allow dependants of a member of the Canadian Forces who have attained voting age to choose where they want to vote at elections and to indicate their intention to vote by completing a statement of ordinary residence.

Le texte modifie la Loi électorale du Canada afin de permettre aux personnes à charge d’un membre des Forces canadiennes qui sont en âge de voter de choisir l’endroit où elles entendent voter lors d’une élection et de faire connaître leur intention de voter en établissant une déclaration de résidence habituelle.

Her Majesty, by and with the advice and consent of the Senate and House of Commons of Canada, enacts as follows:

1. Section 190 of the Canada Elections Act is amended by adding the following in alphabetical order:

“dependant”,  with reference to a member of the Canadian Forces, means a person who forms part of the member’s household, depends on the member for support and normally resides with the member.

1. L’article 190 de la Loi électorale du Canada est modifié par adjonction selon l’ordre alphabétique, de ce qui suit :

« personne à charge » La personne qui fait partie de la maisonnée d’un membre des Forces canadiennes, qui dépend de celui-ci pour sa subsistance et qui réside habituelle-ment avec lui.

2. Section 191 of the Act is amended by striking out the word “and” at the end of paragraph (c) and by adding the following after paragraph (c):

(c.1) a dependant of a member of the Canadian Forces described in paragraph (a), (b) or (c); and

Statement of ordinary residence

3. The portion of subsection 194(1) of the Act before paragraph (b) is replaced by the following:

194. (1) In order to vote under this Division, a person shall, without delay after becoming an elector described in paragraph 191(a), (c), (c.1) or (d), complete a statement of ordinary residence in the prescribed form that indicates

(a) his or her surname, given names, sex and, if applicable, rank;

194. (1) Pour avoir le droit de voter en vertu de la présente section, toute personne doit, sans délai après être devenue un électeur visé aux alinéas 191a), c), c.1) ou d), établir une déclaration de résidence habituelle, selon le formulaire prescrit, indiquant :
