Summary

Sommaire

This enactment amends the Criminal Code by allowing summary proceedings to be taken against a person who commits an offence under subsection 99(1) and by providing for proceedings by way of indictment only against a person who commits an offence under subsection 99.1(1) of that Act.

Le texte modifie le Code criminel en permettant la poursuite par procédure sommaire de toute personne qui contrevient au paragraphe 99(1) et en prévoyant les poursuites par voie de mise en accusation uniquement à l’endroit des personnes qui enfreignent le paragraphe 99.1(1) de cette loi.

Her Majesty, by and with the advice and consent of the Senate and House of Commons of Canada, enacts as follows:

1. (1) The portion of subsection 99(1) of the Criminal Code following paragraph(b) is replaced by the following:

1. (1) Le paragraphe 99(1) du Code criminel est remplacé par ce qui suit :

a firearm or any ammunition knowing that the person is not authorized to do so under the Firearms Act or any other Act of Parliament or any regulations made under any Act of Parliament.

99. (1) Commet une infraction quiconque fabrique ou cède, même sans contrepartie, ou offre de fabriquer ou de céder une arme à feu ou des munitions sachant qu’il n’y est pas autorisé en vertu de la Loi sur les armes à feu, de toute autre loi fédérale ou de leurs règlements.

(2) Subsection 99(2) of the Act is replaced by the following:

(2) Le paragraphe 99(2) de la même loi est remplacé par ce qui suit :

Punishment

(2) Every person who commits an offence under subsection (1) is guilty of an offence and is liable

(a) on summary conviction, to a fine not exceeding two hundred and fifty thousand dollars or to imprisonment for a term not exceeding two years, or to both; or

(b) on conviction on indictment, to a fine not exceeding five hundred thousand dollars or to imprisonment for a term not exceeding five years, or to both.            

(2) Quiconque commet l’infraction prévue au paragraphe (1) est coupable :

a) soit d’une infraction punissable sur déclaration sommaire de culpabilité et passible d’une amende d’au plus deux cent cinquante mille dollars et d’un emprisonnement maximal de deux ans ou de l’une de ces peines;

b) soit d’un acte criminel et passible d’une amende d’au plus cinq cent mille dollars et d’un emprisonnement maximal de cinq ans ou de l’une de ces peines.

2. The Act is amended by adding the following after section 99:

2. La même loi est modifiée par adjonction, après l’article 99, de ce qui suit :

Weapons trafficking

99.1 (1) Every person commits an offence who

(a)manufactures or transfers, whether or not for consideration,

(b) imports or exports, or transports in transit through Canada without authorization, or

(c) offers to do anything referred to in paragraph (a) or (b) in respect of

a prohibited weapon, a restricted weapon, a prohibited device or any prohibited ammunition knowing that the person is not authorized to do so under the Firearms Act or any other Act of Parliament or any regulations made under any Act of Parliament.

99.1 (1) Commet une infraction quiconque fabrique ou cède, même sans contrepartie, importe ou exporte, transporte en transit au Canada sans autorisation ou offre de fabriquer, de céder, d’importer, d’exporter ou de transporter en transit au Canada une arme prohibée, une arme à autorisation restreinte, un dispositif prohibé ou des munitions prohibées sachant qu’il n’y est pas autorisé en vertu de la Loi sur les armes à feu, de toute autre loi fédérale ou de leurs règlements.

Punishment

(2) Every person who commits an offence under subsection (1) is guilty of an indictable offence and liable to imprisonment for a term not exceeding fifteen years and to a minimum punishment of imprisonment for a term of two years.

(2) Quiconque commet l’infraction prévue au paragraphe (1) est coupable d’un acte criminel et passible d’un emprisonnement maximal de quinze ans, la peine minimale étant de deux ans.
