An Act to amend the Canada Transportation Act

1996, c. 10

      Her Majesty, by and with the advice and consent of the Senate and House of Commons of Canada, enacts as follows:

1. Subsection 27(2) of the Canada Transportation Act is replaced by the following:

Limitation

(2) Where an application is made to the Agency by a shipper in respect of a transportation rate or service, the Agency shall grant the relief sought, in whole or in part, unless a person opposing the application proves that it is not in the public interest to grant the relief.

2. The Act is amended by adding the following after section 116:

Application

116.1 For greater certainty, sections 112 to 116 apply to all railway companies that have been granted running rights on any portion of a railway.
