Certificate of qualified technician

31.1 On completion of the taking of the samples of blood from the person pursuant to the warrant issued under section 31.04, the qualified technician shall give to the qualified medical practitioner who caused him to take the samples and to the peace officer responsible for executing the warrant, or to another peace officer in his stead, a copy of a certificate stating

    (a) that the qualified technician took the samples of blood;

    (b) the time and place where the samples of blood were taken; and

    (c) that the blood samples were taken directly from the person mentioned in the warrant.

Duty of analyst

31.11 On completion of the analysis of the samples of the blood of a person pursuant to the warrant issued under section 31.04, the analyst shall give to the peace officer responsible for executing the warrant, or to another peace officer in his stead, and to the qualified medical practitioner referred to in section 31.09 a copy of a certificate containing the results of his analysis.

Duty of peace officer

31.12 As soon as the peace officer receives the certificate from the qualified medical practitioner, the certificate from the analyst and, if appropriate, the certificate from the qualified technician, he shall cause copies to be sent to the applicant and to the person from whom the samples of blood were taken.

PROHIBITIONS

Analysis prohibited

31.13 A sample of blood taken from a person pursuant to a warrant issued under section 31.04 shall not be analysed for any purpose other than the purpose specified in the warrant.

Use prohibited

31.14 The samples of the blood of a person obtained pursuant to a warrant issued under section 31.04 shall not be used for any purpose other than the purpose for which they were obtained.

Offence and penalty

31.15 Every one who contravenes section 31.13 or 31.14 commits an offence punishable on summary conviction.

Prohibition

31.16 No certificate covered by this Act shall be received in evidence

    (a) in a civil proceeding; or

    (b) in a criminal proceeding except in a proceeding under section 31.08.
