CONDITIONAL AMENDMENT

Bill C-44

42. If Bill C-44, introduced in the first session of the thirty-sixth Parliament and entitled An Act to authorize remedial and disciplinary measures in relation to members of certain administrative tribunals, to reorganize and dissolve certain federal agencies and to make consequential amendments to other Acts, is assented to, then

    (a) on the later of the day on which paragraph 42(a) of that Act comes into force and the day on which subsection 25(1) of this Act comes into force, subsection 6(1) of the English version of the Canada Mortgage and Housing Corporation Act is replaced by the following:

6. (1) The Board of Directors shall consist of the Chairperson, the President and eight other members.

    (b) on the later of the day on which paragraph 42(a) of that Act comes into force and the day on which subsection 25(2) of this Act comes into force, subsection 6(4) of the English version of the Canada Mortgage and Housing Corporation Act is replaced by the following:

(4) Each director, other than the Chairperson and the President, shall be appointed by the Minister, with the approval of the Governor in Council, to hold office during pleasure for a term not exceeding three years that will ensure, as far as possible, the expiration in any one year of the terms of office of not more than one half of the directors.

    (c) on the later of the day on which subsection 40(2) of that Act comes into force and the day on which section 26 of this Act comes into force, subsection 7(3) of the Canada Mortgage and Housing Corporation Act is replaced by the following:

(3) The Board, with the approval of the Governor in Council, shall appoint three Vice-Presidents and fix their remuneration.

    (d) on the later of the day on which paragraph 42(b) of that Act comes into force and the day on which section 27 of this Act comes into force, section 9 of the English version of the Canada Mortgage and Housing Corporation Act is replaced by the following:

9. There shall be an Executive Committee of the Board consisting of the Chairperson, the President and three other directors selected by the Board.

Retroactivity of subsection 18(2) of the National Housing Act

43. Subsection 18(2) of the National Housing Act, as enacted by section 3 of this Act, is deemed to have come into force on January 1, 1997.
