RECOMMENDATION

His Excellency the Governor General recommends to the House of Commons the appropriation of public revenue under the circumstances, in the manner and for the purposes set out in a measure entitled ``An Act respecting marine conservation areas''.

SUMMARY

This enactment provides authority for the establishment of marine conservation areas with the objective of protecting and conserving a variety of aquatic environments. Additions of new marine conservation areas would be subject to parliamentary approval. The enactment confers a range of regulatory powers for the protection of living and non-living marine resources and their management and use in a sustainable manner.

EXPLANATORY NOTES

Clause 31: The relevant portion of subsection 4(2) reads as follows:

(2) The Minister's jurisdiction referred to in subsection (1) encompasses, but is not limited to, jurisdiction over

    . . .

    (e) national parks, national historic sites, historic canals, national battlefields, national marine conservation areas, heritage railway stations and federal heritage buildings;

Clause 32: The definition ``park'' in section 2 reads as follows:

``park'' means a National Park or National Marine Park described in Schedule I;

Clause 33: (1) Subsection 10(2) reads as follows:

(2) Subject to subsection (3), the Governor in Council may, by a proclamation amending Schedule I to the National Parks Act, establish a National Marine Park in the county of Bruce in the province of Ontario under the name designated and having the boundaries set out in the proclamation.

(2) The relevant portion of subsection 10(3) reads as follows:

(3) A proclamation may be issued pursuant to subsection (1) or (2) where

    (b) the government of the province in which the lands are situated has agreed that they are suitable for a National Park or a National Marine Park, as the case may be; and
