SUMMARY

This enactment amends the Patent Act to require the Patented Medicine Prices Review Board to conduct an annual investigation of patentees of inventions pertaining to medicines to determine whether they have made fair and reasonable efforts to make available in Canada for the treatment of seriously ill persons medicines for which they hold the patent. Not later than the 30th day of September in every year, the Board must submit a report regarding its annual investigation for the preceding year to the Minister.

The enactment also provides that the Patented Medicine Prices Review Board must, at the request of a seriously ill person, make an investigation similar to the one described above concerning the patentee of an invention pertaining to a medicine referred to in the request. In such a case, the Board is given a brief period in which to conduct its investigation and to submit its report to the Minister of Industry.
