An Act to amend the Canada Elections Act (reimbursement of election expenses)

      Her Majesty, by and with the advice and consent of the Senate and House of Commons of Canada, enacts as follows:

1. Subsection 322(1) of the Canada Elec tions Act is replaced by the following:

Certification of amount

322. (1) On receipt of a registered party's election expense return referred to in section 46 and the auditor's report referred to in section 43 relating to the return, the Chief Electoral Officer shall, where a registered party has obtained, at the election in respect of which the return and report relate, a number of votes at least equal to

    (a) two per cent of the number of valid votes cast at the election, or

    (b) five per cent of the number of valid votes cast in the electoral districts in which the registered party endorsed a candidate,

transmit to the Receiver General in respect of the registered party a certificate setting out the amount that is twenty-two and one-half per cent of the amount of the registered party's election expenses as disclosed in the return.
