An Act to amend the Tobacco Products Control Act

R.S., c. 14 (4th Supp.)

Her Majesty, by and with the advice and consent of the Senate and House of Commons of Canada, enacts as follows:

1. Subsection 9(1) of the Tobacco Products Control Act is replaced by the following:

Health messages

9. (1) No distributor shall sell or offer for sale a tobacco product unless, if and as required by the regulations,

    (a) the package containing the product displays

      (i) messages pertaining to the health effects of the product and of the toxic constituents of the product and, where applicable, of the smoke produced from its combustion, which messages may, at the option of the distributor, be attributed to a prescribed entity, and

      (ii) a list of those toxic constituents and their quantities; and

    (b) a leaflet has been placed inside the package

      (i) furnishing information relative to the health effects of the product and of the toxic constituents of the product and, where applicable, of the smoke produced from its combustion, which information may, at the option of the distributor, be attributed to a prescribed entity, and

      (ii) displaying a list of those toxic constituents and their quantities.

2. Paragraphs 17(f) and (g) of the Act are replaced by the following:

    (f) requiring, in respect of any tobacco product, that messages and lists referred to in paragraph 9(1)(a) be displayed on pack ages and prescribing, for the purposes of that paragraph,

      (i) the content of the messages, the substances that are toxic constituents and the name of the entity, and

      (ii) the appearance of the messages, of the list of toxic constituents and of the name of the entity, including their posi tion, configuration, size, colour and prominence;

    (g) requiring, in respect of any tobacco product, that leaflets referred to in para graph 9(1)(b) be placed inside packages and prescribing, for the purposes of that para graph,

      (i) the content, form, and manner of placement of the leaflets,

      (ii) the content of the information, the substances that are toxic constituents and the name of the entity, and

      (iii) the appearance of the information, of the list of toxic constituents and of the name of the entity, including their posi tion, configuration, size, colour and prominence;

Coming into force

3. This Act comes into force on a day to be fixed by order of the Governor in Council.
