R.S., c. 33 (1st Supp.)

An Act to amend the Aeronautics Act

36. Paragraph 6(2)(c) of the Aeronautics Act, as enacted by section 1 of An Act to amend the Aeronautics Act, being chapter 33 of the 1st Supplement to the Revised Statutes of Canada, 1985, is replaced by the following:

    (c) would, when made, be exempt from publication by virtue of this Act or regulations made under subsection 5(1) of the Regulations Act.

37. Section 556 of the Bank Act is repealed.

1992, c. 27, s. 5(4)

38. Subsection 5(6) of the Bankruptcy and Insolvency Act is replaced by the following:

Directives

(6) A directive issued by the Superintendent under this section is not a regulation for the purposes of the Regulations Act.

Canada Evidence Act

39. The Canada Evidence Act is amended by adding the following after section 18:

Documents published in the Canada Gazette

18.1 Judicial notice shall be taken of any document that has been published in the Canada Gazette or of any revision or consolidation of regulations purporting to be printed by the Queen's Printer.

40. Paragraph 21(a) of the Act is repealed.

41. The Act is amended by adding the following after section 21:

Officially published documents

21.1 In addition to any other manner of proving the existence or contents of a document, evidence of its existence or contents may be given by the production of

    (a) a copy of the Canada Gazette or a volume of the Acts of Parliament purporting to contain a copy of the document; or

    (b) a copy of a revision or consolidation of regulations purporting to be printed by the Queen's Printer.

42. Subsection 22(2) of the Act is repealed.

Canada-Newfoundland Atlantic Accord Implementation Act

43. Subsection 126(3) of the Canada-Newfoundland Atlantic Accord Implementation Act is replaced by the following:

Forms not regulations

(3) Where a form or information to be given on a form is prescribed by the Board pursuant to this Act, it is not a regulation for the purposes of the Regulations Act.

44. Subsection 151.1(2) of the Act is replaced by the following:

Not regulations

(2) Guidelines and interpretation notes issued pursuant to subsection (1) are not regulations for the purposes of the Regulations Act.

Canada-Nova Scotia Offshore Petroleum Resources Accord Implementation Act

45. Subsection 129(3) of the Canada-Nova Scotia Offshore Resources Accord Implementation Act is replaced by the following:

Forms not regulations

(3) Where a form or information to be given on a form is prescribed by the Board pursuant to this Part, it is not a regulation for the purposes of the Regulations Act.

46. Subsection 156(2) of the Act is replaced by the following:

Not regulations

(2) Guidelines and interpretation notes issued pursuant to subsection (1) are not regulations for the purposes of the Regulations Act.

47. Subsection 113.1(9) of the Canada Pension Plan is replaced by the following:

(9) A regulation made pursuant to subsection (6) is exempt from the application of the regulatory process under the Regulations Act.

48. Subsection 108(3) of the Canada Petroleum Resources Act is replaced by the following:

(3) Where a form or information to be given on a form is prescribed by the Minister pursuant to this Act, the form is not a regulation for the purposes of the Regulations Act.

49. Subsection 4(3) of the Canada Student Financial Assistance Act is replaced by the following:

Regulations Act does not apply

(3) The Regulations Act does not apply in respect of directives given under subsection (2).

50. Section 3 of the Canadian Bill of Rights is replaced by the following:

Duties of Minister of Justice

3. (1) Subject to subsection (2), the Minister of Justice shall, in accordance with such regulations as may be prescribed by the Governor in Council, examine

    (a) every regulation registered by the Clerk of the Privy Council under the Regulations Act, and

    (b) every Bill introduced in or presented to the House of Commons by a minister of the Crown

in order to ascertain whether any of its provisions are inconsistent with the purposes and provisions of this Part and the Minister shall report any such inconsistency to the House of Commons at the first convenient opportunity.

Exception

(2) A regulation need not be examined in accordance with subsection (1) if it was reviewed as a proposed regulation in accordance with section 7 of the Regulations Act to ensure that it was not inconsistent with the purposes and provisions of this Part.

Canadian Environmental Assessment Act

51. Subsection 52(3) of the Canadian Environmental Assessment Act is replaced by the following:

(3) The order shall be published in the Canada Gazette as soon as possible after it is approved by the Governor in Council.

52. Subsection 35(6) of the Canadian Environmental Protection Act is replaced by the following:

Exemption from the Regulations Act

(6) An interim order

    (a) is exempt from the application of the regulatory process under the Regulations Act; and

    (b) shall be published in the Canada Gazette as soon as possible after it is approved under subsection (3).

53. Subsection 10(3) of the Canadian International Trade Tribunal Act is repealed.

56. Subsection 17(3) of the Contraventions Act is replaced by the following:

Exemption from review under the Regulations Act

(3) Section 7 of the Regulations Act does not apply in respect of an order of the lieutenant governor in council of a province under subsection (2).

57. Section 460 of the Cooperative Credit Associations Act is repealed.

Cree-Naskapi (of Quebec) Act

58. Section 9 of the Cree-Naskapi (of Quebec) Act is replaced by the following:

Regulations Act does not apply

9. The Regulations Act does not apply to a by-law or resolution of a band made under this Act.

Customs Act

59. Section 167.1 of the Customs Act is replaced by the following:

Retroactive effect

167.1 Where a regulation made under a provision of this Act provides that the regulation is to come into force on a day earlier than the day it is registered under section 9 of the Regulations Act, the regulation comes into force on that earlier day if the regulation

    (a) has a relieving effect only;

    (b) gives effect, in whole or in part, to a public announcement made on or before that earlier day;

    (c) corrects an ambiguous or deficient enactment that was not made in accordance with the objects of this Act or the regulations made by the Governor in Council under this Act; or

    (d) is consequential on an amendment to this Act that is applicable before the day the regulation is registered under section 9 of the Regulations Act.

60. Paragraph (b) of the definition ``federal customs laws'' in subsection 2(1) of the Customs and Excise Offshore Application Act is replaced by the following:

      (b) regulations as defined in section 2 of the Regulations Act, and

61. Subsection 60.01(8) of the Customs Tariff is replaced by the following:

Exemption from regulatory process

(8) An order under subsection (1) is exempt from the application of the regulatory process under the Regulations Act.

62. Subsection 60.2(11) of the Act is replaced by the following:

Exemption from regulatory process

(11) An order made pursuant to subsection (1) is exempt from the regulatory process under the Regulations Act.

1992, c. 28, s. 38

63. Subsection 108(2) of the Act is replaced by the following:

Retroactive effect

(2) A regulation made under subsection (1) that provides that it is to come into force on a day earlier than the day it is registered under section 9 of the Regulations Act comes into force on that earlier day if it gives effect to a public announcement made on or before that earlier day.
