This enactment amends the Divorce Act to allow a grandparent to apply for custody of his or her grandchild without leave of the court.

Le texte modifie la Loi sur le divorce afin de permettre au grand-père ou à la grand-mère de demander la garde des petits-enfants sans obtenir l’autorisation du tribunal.

1. Subsection 16(3) of the Divorce Act is replaced by the following:

(3) A person, other than a spouse or a grandparent related to the children by consan-guinity or adoption, may not make an applica-tion under subsection (1) or (2) without leave of the court.

(3) Pour présenter une demande au titre des paragraphes (1) et (2), une personne –– autre qu’un époux, un grand-père ou une grand-mère ayant avec les enfants un lien de parenté
par consanguinité ou adoption –– doit obtenir l’autorisation du tribunal.
