Summary

Sommaire

The purpose of this enactment is to amend the Canada Transportation Act in order to make it more difficult for adults and non-custodial parents to abduct children by means of air transportation.  The legislation is also aimed at reducing the incidence of child abduction and kidnapping in Canada, by requiring all adult passengers travelling with young persons to produce written proof of the consent of their parents or of other persons who have lawful custody over them.

Le texte modifie la Loi sur les transports au Canada afin de tenter de prévenir l’enlèvement en aéronef d’un enfant par un adulte ou par le parent qui n’en a pas la garde. Il vise également à réduire le nombre d’enlèvements d’enfants au Canada en exigeant de tout passager adulte qui voyage avec un enfant une preuve écrite du consentement à cet égard des parents de l’enfant ou de toute autre personne qui en a la garde légale.

Her Majesty, by and with the advice and consent of the Senate and House of Commons of Canada, enacts as follows:

1. The Canada Transportation Act is amended by adding the following after section 68:

68.1 (1) The holder of a domestic licence shall not allow an adult passenger to travel with a child under the age of sixteen years unless the adult passenger provides written proof of the consent of the child’s parents, or of any other person who has lawful care or charge of the child, to travel with the child.

68.1 (1) Le titulaire d’une licence intérieure ne peut permettre au passager adulte de voyager avec un enfant âgé de moins de seize ans que si cet adulte fournit une preuve écrite du consentement à cet égard soit des parents de l’enfant, soit de toute autre personne qui en a la garde légale.

(2) In the case of a non-custodial parent who travels with a child under the age of sixteen years, the holder of a domestic licence shall not allow that parent to travel with the child unless the parent provides written proof of the consent of the custodial parent, or of any other person who has lawful care or charge of the child, for the non-custodial parent to travel with the child.

(2) Le titulaire d’une licence intérieure ne peut permettre au parent de voyager avec son enfant âgé de moins de seize ans dont il n’a pas la garde que si ce parent fournit une preuve écrite du consentement à cet égard soit du parent qui en a la garde, soit de toute autre personne qui en a la garde légale.
